小明在某連鎖飲料店打工,與老闆約定按時計薪,平常週一至週五上班,1天工作6小時,但週末人力不足,老闆要求小明在週六(休息日)也要到店裡上班4小時,然而到了發薪日,雇主認為小明單週只工作34小時,未達單週40小時的法定正常工時上限,因此未依加班費的計算標準核發週六4小時的出勤工資,小明多次反映未果,向勞工局提出申訴。

勞工局指出,部分雇主認為工讀生僅需依照出勤時數核發時薪即可,但工讀生的勞動權益與全職勞工無異,單週內應排定1日例假日(不能出勤)及1日休息日(出勤應以加班費標準計給工資),一旦勞工單週出勤達第6日(即休息日出勤),雇主就應依照勞基法第24條規定,以加班費標準計給當日出勤工資。

勞工局提醒,為確保勞工法定權益,並督促雇主落實法定義務,勞檢處每年都會實施「工讀生與部分工時勞工勞動條件專案檢查」,去年發現雇主未依規定計給加班費占大多數,若業者違反勞基法規定,可處2萬元以上、100萬元以下罰鍰,並公布業者名稱及負責人姓名等資訊。
