Canadian Man Acquitted After 18 Months in Prison Due to Missing Underscore

A Canadian man who spent 18 months in prison has been fully acquitted after an appeals court found that a minor error in a police request led investigators to wrongly identify him in a child exploitation case, CTV News reported. The Nova Scotia Court of Appeal has overturned the conviction of Brandon Klayme, ruling that he should never have been charged or prosecuted. Judges said the case stemmed from a simple mistake involving a username on a messaging platform. Klayme, from Dartmouth in Nova Scotia, was convicted in 2023 of child luring and possession of child pornography. He was sentenced in January 2024 to 18 months in prison followed by 18 months of probation. He had already completed his prison term and was serving probation when he launched his appeal.

Investigation began with US complaint

The case originated in Wisconsin, where a 12-year-old girl told police she had been communicating with an adult on the Kik messaging app. She said the user, identified as “fus__ro_dah”, exchanged messages and sexual content with her between August and December 2018. Her mother later discovered the material on the child’s phone and alerted authorities. When investigators attempted to trace the account, they submitted a request that mistakenly omitted one underscore, searching instead for “fus_ro_dah”. That small discrepancy redirected the investigation to Klayme’s account. Police then obtained his email details and linked an IP address to Halifax, Nova Scotia, before transferring the case to local authorities. Halifax Regional Police searched his home and seized electronic devices, but found no evidence connecting him to the alleged offences.

Court finds wrongful identification

Despite the absence of supporting evidence, Klayme was charged and later convicted. In his appeal, he said a minor error had “changed the course of my life.” The Court of Appeal agreed, finding that the incorrect username led investigators to the wrong individual. Judges noted that the proper spelling would have pointed to a different person, likely based in California. In its July 23 ruling, the court said Klayme was “factually innocent” and should never have been prosecuted. The judges quashed his conviction and vacated his sentence, clearing him of all charges.
