주주운동본부는 오후 1시30분께 서초구 대법원 앞에서 기자회견을 열고 삼성전자 노사 협약에 적힌 성과급 규정은 상법상 노사 합의 사안이 아니라며 이같이 말했다 .
잠정 합의안에 따르면 노사는 OPI(성과 인센티브)와 반도체(DS) 부문에 대한 특별경영성과급으로 구분해 성과급을 지급하기로 했다.
특별경영성과급은 노사가 선정한 사업 성과의 10.5%를 재원으로 삼고 지급률 상한은 따로 두지 않는다.
주주운동본부는 대법원 판례상 이 같은 형태의 성과 인센티브는 노사가 합의할 수 있는 '임금 등 근로조건'이 아니라고 강조했다.
이들은 "상법 위반 없이 노조와 경영진이 각 주주를 설득해 주총 의결로 성과 배분을 승인받으면 되는 것"이라며 "그렇게 하면 하자는 치유되고 협약 무효 소송은 진행의 필요성이 없을 것"이라고 강조했다.
주주운동본부는 전날에도 이재용 삼성전자 회장 자택 일대에서 집회를 열고 노사 합의에 대한 효력정지 가처분 및 무효확인 소송 등을 진행하겠다고 밝혔다.
