鄭智文說,婚姻的維持靠「信任」,如果信任崩盤,很多問題都會浮上檯面!國人經常為了「避稅、避債」方便,常把房地產登記在子女或夫妻單一方,「借名登記」若無書面契約、匯款紀錄或明確約定,事後想主張「不當得利」或「借名」,舉證難度極高。鄭智文強調,權利主張要及時,拖延就是棄權。重大財產權益一旦知悉有異,就該立刻以書面、律師函或訴訟方式固定權利。婚姻存續時「怕傷感情」而忍耐,離婚後才算總帳,往往已逾「合理期間」,法院不會同情。

鄭智文表示,婚姻破裂時,「信賴基礎」會徹底崩潰,法律只看證據不看感情。該案離婚是「太太有外遇」,但太太有外遇,不代表其名下的財產就是不當得利或屬有害債權。民法第二四四條債權人撤銷權必須「以債權存在為前提」,丈夫並非妻子的債權人,這筆財產登記也不是「有害債權的無償行為」,法官可能認為這是贈與或家族安排。
