未來毒駕刑期提升為5年以下有期徒刑，得併科50萬元以下罰金；毒駕致重傷者，處3年以上10年以下有期徒刑，得併科200萬元以下罰金；毒駕致人於死者，處5年以上12年以下有期徒刑，得併科300萬元以下罰金。
10年內再犯毒駕致重傷者，處5年以上12年以下有期徒刑，得併科300萬元以下罰金；10年內再犯毒駕致死者，處無期徒刑或7年以上有期徒刑，得併科400萬元以下罰金。
此外，草案也規範，無論酒駕、毒駕肇事致人於死或重傷都將「沒收車輛」，就算不能沒收，也會追徵其價額。
