Utah Can Enforce Anti-Gambling Laws on Prediction Markets, Federal Judge Rules

A federal judge has ruled that Utah can enforce its strict anti-gambling laws on prediction markets like Kalshi and Polymarket. This decision represents a significant victory for states aiming to regulate the increasingly popular betting platforms.

Utah has been at the forefront of a legal dispute between states and the federal government concerning the regulation of these markets and their classification as either financial instruments or gambling.

Kalshi filed a lawsuit against Utah in February, seeking a federal injunction to prevent the state from applying its gambling restrictions to the platform. This legal action followed Utah's imminent passage of legislation designed to restrict prediction market operations within the state.

State law in Utah now prohibits proposition betting in sports, a practice that involves wagering on specific events occurring during a game rather than the game's final outcome. This type of betting is a substantial revenue source for major prediction markets.

U.S. District Judge Robert Shelby rejected Kalshi's request to block Utah's restrictions on Tuesday. He stated that the federal law cited by Kalshi in its argument does not preempt the state's authority to enforce its own laws.

Currently, Utah residents can still place bets on these platforms. However, the state's Attorney General, Derek Brown, has indicated his intention to enforce state laws on Kalshi, while also exploring further options. "Gambling is gambling, no matter what any company calls it," Brown stated.

Kalshi expressed its disagreement with the ruling and announced plans to appeal. The company maintains that prediction markets fall under exclusive federal jurisdiction and should not be subject to a fragmented set of state gambling laws. The Commodity Futures Trading Commission (CFTC), the federal agency overseeing financial markets, shares this view and has defended prediction markets in legal proceedings.

This ruling contrasts with decisions in other jurisdictions. Courts in Maryland, Nevada, Ohio, New York, and Wisconsin have ruled against Kalshi in similar cases. Conversely, judges in New Jersey, Tennessee, Arizona, and Minnesota have ruled in favor of the company. Some states have imposed restrictions on certain aspects of Kalshi's operations without implementing outright bans.

The Trump administration has shown support for prediction markets, which enable individuals to wager on a wide range of events. The former president's eldest son serves as an advisor to both Kalshi and Polymarket and is an investor in Polymarket through his venture capital firm. Additionally, Trump's social media platform, Truth Social, is launching its own cryptocurrency-based prediction market named Truth Predict.

Utah leaders, including Governor Spencer Cox, have framed their efforts to curb what they perceive as gambling as a moral mission. This stance is influenced by the cultural values of The Church of Jesus Christ of Latter-day Saints, headquartered in Utah, which regards gambling as a detrimental vice associated with selfishness and addiction.

Governor Cox celebrated the ruling, stating that prediction markets are "causing tremendous harm to countless American families."
