租賃房屋供執業使用的業者要特別留意!財政部表示,若承租人依租約約定,代房東負擔房屋稅、地價稅、扣繳稅款、二代健保補充保費、房屋火險及地震險保費,甚至修繕費等相關支出,這些代墊費用都屬於租賃房屋的對價,應視同租金收入,併入租金給付總額計算,並依法辦理扣繳及申報扣(免)繳憑單。

財政部高雄國稅局指出,租賃雙方若約定由承租人代出租人履行納稅義務,或代為支付租賃財產的修理維護、擴建費用,以及其他原應由出租人負擔的債務,實質上均屬於承租人為取得房屋使用權所支付的代價。

國稅局說明,無論是直接支付現金租金,或代房東支付各項費用,其經濟實質並無不同,因此相關金額都應納入租金給付總額計算,作為扣繳及申報依據。

國稅局舉例,A地政士事務所於113年度向甲君承租執業場所,雙方約定每月租金1萬5,000元,全年租金共18萬元。此外,房屋稅、地價稅及房屋火險費等費用合計1萬8,000元,也由事務所代為負擔。

該事務所在帳務上已將相關代墊費用列報於租金支出科目,但申報扣(免)繳憑單時,僅申報全年租金18萬元,未將代墊的1萬8,000元併入租金給付總額,導致申報資料與規定不符,最終因扣(免)繳憑單申報錯誤而遭處罰。

依照國稅局認定,該年度實際租金給付總額應為19萬8,000元,而非僅有18萬元。

國稅局提醒,執行業務所得者及其他所得業者等扣繳單位,若依租約約定代出租人支付各項稅捐、保險費或其他相關費用,這些支出本質上均屬租賃房屋的代價,與支付租金具有相同性質。

因此,扣繳義務人辦理扣繳申報時,應將相關代墊費用一併納入租金給付總額,據以計算扣繳稅款及填報扣(免)繳憑單,以免因漏報或短報而遭補稅甚至受罰。
