The court heard Bartlett had been out drinking with the baby's mother, Evelyn Ballentyne, on their first evening out since Atticus was born. Prosecutors said he consumed eight-and-a-half pints of beer before returning to their home in Chard, where the infant had been cared for by his maternal grandparents. After the grandparents left, Ballentyne went upstairs briefly, leaving Bartlett alone with the baby. Minutes later, she returned after hearing Atticus struggling to breathe and found him limp and unresponsive. She immediately sought help from neighbours and called emergency services, telling the operator her four-week-old son was not breathing. Atticus was taken to hospital but died seven days later. Medical experts told the court the infant had suffered severe trauma to his brain and spinal cord. A paediatric neurosurgeon said the injuries were comparable to those seen in high-speed road traffic collisions or falls from a significant height and could not have been caused by illness or ordinary handling. Prosecutors argued Bartlett lost his temper and violently assaulted the baby, with his actions likely fuelled by alcohol. During police interrogation, Bartlett denied shaking his son. He claimed Atticus had refused a bottle and that he had only been rubbing his back, patting him and bouncing him on his knee because he believed the baby had trapped wind. Ballentyne was initially arrested during the investigation but was not charged with any offence and later gave evidence during the trial.
