對此，律師林智群分享經辦監護宣告案的實務經驗，他指出失智症依病程進展有不同階段，剛開始患者在日常社交上與常人無異，除家屬外，外界極難察覺異狀，通常要到中後期才會表現出明顯症狀。
林智群今日發文指出，他曾受理一起令人印象深刻的案件。當時1名阿婆的家屬前來委託，表示阿婆要狀告親生兒子侵占財產。
由於得知阿婆患有失智症，為求謹慎特地南下與阿婆當面討論，確認阿婆的意志仍是清楚的。
林智群回憶，當時阿婆的病情應已步入中後期，但在言談間，唯獨對於「兒子侵占財產、堅持提告」這件事的態度極為堅定、意志清晰，經評估後協助提告。
林智群透露，果不其然，開庭後對方律師立刻展開法律攻防，主張阿婆早已失智，根本沒有提告兒子的自主意願。
法官為釐清真相，特別傳喚阿婆出庭應訊，阿婆在法庭明確表示要提告後說服法官。
與此同時，阿婆的家屬也同步向法院聲請監護宣告。
該案經醫院進行專業精神鑑定後，法院最終裁定「輔助宣告」。
林智群強調，「失智症不代表他完全不知道事情沒有判斷能力，還是要看失智症的進程」。
