3일 울산선관위에 따르면 B씨는 20여만원 상당의 생수 등 음료를 선거운동원들이 무상으로 취식할 수 있도록 한 혐의를 받는다.
공직선거법 제114조는 후보자의 선거사무장·선거연락소장·회계책임자 등이 선거와 관련해 기부행위를 하는 것을 금지하며, 후보자나 정당을 위해 금품이나 그 밖의 이익을 제공하는 행위를 기부행위로 본다고 규정한다.
또 이를 위반하면 5년 이하 징역이나 1천만원 이하 벌금에 처하도록 규정하고 있다.
울산선관위는 "금품·음식물 제공 등 기부행위는 선거 공정성을 훼손하는 중대한 위법행위"라며 "선거와 관련한 기부행위에 대해서는 예외 없이 엄정하게 조사해 조치할 방침"이라고 밝혔다.
