此次“两高”发布的规定共24条，自今年5月22日起施行。其中明确，犯罪嫌疑人、被告人涉嫌犯数罪，其中部分犯罪符合刑事诉讼法第二百九十一条第一款规定的，可以对该部分犯罪案件适用缺席审判程序。共同犯罪案件中，部分犯罪嫌疑人、被告人在境外，符合刑事诉讼法第二百九十一条第一款规定的，可以对该部分犯罪嫌疑人、被告人适用缺席审判程序。
根据刑事诉讼法第二百九十一条，对于贪污贿赂犯罪案件，以及需要及时进行审判，经最高人民检察院核准的严重危害国家安全犯罪、恐怖活动犯罪案件，犯罪嫌疑人、被告人在境外，监察机关、公安机关移送起诉，人民检察院认为犯罪事实已经查清，证据确实、充分，依法应当追究刑事责任的，可以向人民法院提起公诉。人民法院进行审查后，对于起诉书中有明确的指控犯罪事实，符合缺席审判程序适用条件的，应当决定开庭审判。
此次“两高”发布的规定还提出，向被告人送达相关诉讼文书，应当通过有关国际条约规定的或者外交途径提出的司法协助方式，或者被告人所在地法律允许的其他方式进行。
2021年12月，河南省郑州市中级人民法院公开开庭缺席审理了“百名红通”人员河南省漯河市委原书记、豫港(集团)有限公司原董事长程三昌贪污一案。该案被称为中国“刑事缺席审判第一案”。程三昌在境外，其近亲属代为委托两名辩护人为其出庭辩护。
2022年1月，程三昌贪污案一审宣判。法院对其以贪污罪判处有期徒刑十二年，并处罚金人民币五十万元；追缴程三昌贪污犯罪所得依法予以返还。(完)
