토허구역에서 주택을 매입하면 토지거래허가 이후 4개월 이내에 입주해 2년간 실거주해야 한다. 그러나 작년 10·15 대책으로 서울 전역과 경기 12개 지역이 토허구역으로 지정되면서, 임대차계약 기간이 남은 세입자가 있는 경우 매수자가 즉시 입주하기 어려운 문제가 있었다.
정부는 이러한 점을 고려해 지난 12일 기준 토허구역 내 임대차계약이 존재하는 모든 주택에 대해 실거주 의무를 계약 종료 시점까지 유예했다.
다만 올해 12월 31일까지 관할 관청에 토지거래허가를 신청해야 하며, 허가받은 이후 4개월 이내에 주택 취득 절차를 마쳐야 한다.
매수자는 지난 12일부터 계속 무주택 상태를 유지한 경우로 한정한다.
김윤덕 국토부 장관은 "이번 조치는 지난 2월 12일 시행된 실거주 유예 조치가 일부 다주택자에게만 적용된 데 따른 형평성 문제를 해소하기 위한 것"이라며 "갭투자를 불허한다는 원칙은 유지한다"고 말했다.
