交通部本週預告修正「鐵路立體交叉及平交道防護設施設置標準與費用分擔規則」草案，寫明現有鐵路路線不再新設平交道，但有例外狀況時，經主管機關同意後可設置。
為何提出這項修法？交通部鐵道局說明，前次修正至今已屆30年，考量環境變遷及平交道事故屢次發生，為改善平交道安全、提升其防護設施設備、釐清平交道的類型歸屬與維養權責，才提出修法。
主要修正重點包括明定鐵路平交道範圍、分類、設置條件；明定平交道鐵路機構與道路主管機關管理維護範圍；以不再新建鐵路平交道為原則。另外，就第三種鐵路平交道，增訂第三甲種鐵路平交道和第三乙種鐵路平交道。另鐵路機構應評估平交道遮斷器的遮斷範圍及設置障礙物偵測設備計畫。
在沒有鐵路地下化、高架化的路段，目前全台還有415處平交道，其中約350處位於正線，根據統計，2023年到2025年正線平交道事故各為11件、9件、7件。鐵道局指出，希望透過相關改善工程，朝零事故的目標邁進。
台鐵公司也補充，已在全台共313處平交道設置障礙物偵測系統，之後仍有約84處需繼續安裝，預計在2031年以前全部安裝完畢，初估所需費用約4億元。
