UK PM Andy Burnham Considers Exemptions for Sex Offenders in Early Release Scheme

UK Prime Minister Andy Burnham is considering exempting child sex offenders and other serious sexual abuse perpetrators from a controversial early prison release scheme as ministers race to finalise safeguards before the policy takes effect in September. The review comes as the government struggles to balance mounting prison overcrowding with concerns over public safety and victims' rights.

Government reviews exemptions before rollout

According to The Guardian, the UK government is expected to decide within the next 24 hours which categories of offenders should be excluded from the early release scheme, with ministers warning that prisons could run out of space if no action is taken. The policy, introduced under the Sentencing Act 2026, aims to ease severe overcrowding by allowing some serious offenders to be released after serving half of their sentence instead of two-thirds, while less serious offenders could become eligible for release after serving one-third of their sentence instead of 40 per cent. According to reports, Burnham is particularly keen to ensure that child rapists and perpetrators of serious sexual abuse are not released early after victims' groups and support organisations warned that such a move could place survivors at greater risk. The review is expected to conclude shortly so that the Prison Service has enough time to prepare before the first group of around 700 prisoners is released this autumn. The scheme will also be accompanied by expanded electronic monitoring of offenders.

Balancing prison capacity and public safety

Ministers have acknowledged that England and Wales' prison system is nearing capacity, with officials warning that failing to create additional space could push the criminal justice system into crisis. At the same time, every exemption granted to one category of offenders is expected to prompt demands for similar exclusions for others, making the final decision politically sensitive. The issue gained further attention after the family of murdered police officer Andrew Harper objected to reports that two of his killers could qualify for early release, calling the prospect another painful blow. Victims' advocates have also urged the government to strengthen safeguards, arguing that any sentencing reforms must prioritise risk assessment, victim protection and effective offender management alongside efforts to reduce prison populations.

Conservatives demand tougher action

The opposition Conservatives have urged Burnham to introduce emergency legislation to block the early release of serious offenders, including convicted paedophiles, rapists and killers. The party argues that dangerous criminals should not benefit from measures designed to ease overcrowding and has criticised proposals that could allow some prisoners to leave jail after serving significantly less of their sentences. The Conservatives have also pointed to reports that up to 6,000 offenders could be released in September under the reforms, saying the government should prioritise public safety over reducing prison numbers.

Prison reforms remain under scrutiny

The Sentencing Act also seeks to reduce the use of short prison sentences by replacing many of them with probation and community-based punishments, a move critics say could place additional pressure on already stretched probation services. While prison reform advocates argue that reducing overcrowding is essential to prevent the justice system from grinding to a halt, victims' organisations maintain that stronger protections are needed before the reforms are implemented, ensuring high-risk offenders are not released prematurely.
