判決などによると、両被告は市長と市議だった昨年5月に行われた指名競争入札をめぐり、業者側と共謀。程岡被告が最低制限価格を永野被告に電話で漏らし、永野被告が業者側に伝え、最低制限価格を1万円上回る5913万円で落札させた。
田中裁判長は判決で「（程岡被告は）秘密情報を知る立場を誇示し虚栄心を満たすために犯行に及んだ」と述べた。
