Ein konservativ besetztes Berufungsgericht hat den Zugang zu dem Abtreibungsmedikament Mifepriston landesweit deutlich begrenzt. Die einstimmige Entscheidung betrifft insbesondere Bundesstaaten, in denen Schwangerschaftsabbrüche bereits verboten sind. Die Klage wurde von Louisiana eingereicht, das gemeinsam mit etwa 20 weiteren konservativen Bundesstaaten seit 2022 das Abtreibungsrecht eingeschränkt hat.
Ein Berufungsgericht hat die Einschränkung des Zugangs zur Abtreibungspille Mifepriston bestätigt. Das konservative Dreiergremium entschied einstimmig gegen die 2023 eingeführte Versandregelung. Besonders betroffen sind Bundesstaaten mit ohnehin verbotenem Schwangerschaftsabbruch. Die Hersteller Danco Laboratories und GenBioPro verteidigen die bestehende FDA-Regelung.
Danco Laboratories filed an emergency appeal to the US Supreme Court on May 2 asking it to halt a lower court ruling requiring in-person exams before mifepristone can be prescribed. The appeal came hours after the 5th Circuit Court of Appeals temporarily reinstated the in-person dispensing requirement, blocking telemedicine providers from prescribing the abortion pill by mail in response to Louisiana's challenge. Danco warned the ruling would cause chaos and force providers and patients to guess at what is allowed. Louisiana argues mail delivery allows women to bypass abortion bans. The FDA is currently reviewing the drug's safety.
