Ezgi Apartment case in Kahramanmaraş: Trial continues regarding the death of 35 people

During the February 6 earthquakes in Kahramanmaraş, 35 people lost their lives, the youngest of whom was 6-month-old baby Asude, as a result of the collapse of Ezgi Apartment in Onikişubat district.

Kahramanmaraş Chief Public Prosecutor's Office filed a lawsuit against Sami Kervancıoğlu and Mustafa Pekel, the officials of the patisserie operating on the ground floor of the building, and the defendant Ertan Danacı, who organized the renovation of the patisserie, for "killing with possible intent" and "injuring with possible intent" 35 times, and against the contractor Yakup Aktaş and the technical responsible Mehmet Tekin for "causing death and injury through conscious negligence".

In addition, a lawsuit was filed against Fahri Yiğitoğlu, Veli Çiftaslan and Mehmet Dışçeken, who worked in Kahramanmaraş Municipality when the building was built, and Onikişubat Municipality staff Sait Avşar, Ali Gemci, Mehmet Akif Yaşam and Mustafa Şirikçi, who did not supervise the renovations in the patisserie, for "causing death and injury by negligence". Contractor Aktaş lost his life during the trial process.

THE OPINION ON THE MAINS WAS ANNOUNCED

Kahramanmaraş Chief Public Prosecutor's Office announced its opinion on the merits before the 11th hearing, and the defendants Mustafa Pekel, Sami Kervancıoğlu and Ertan Danacı were charged with "intentional murder with possible intent, aggravated intentional killing with possible intent, wounding with possible intent", technical officer Mehmet Tekin was charged with "causing death and injury with conscious negligence", and 7 public officials were charged with "causing death and injury with negligence". He wanted them to be punished.

The hearing held at the Kahramanmaraş 4th High Criminal Court; Detained defendants Sami Kervancıoğlu and Mustafa Pekel, undetained defendants Mehmet Tekin and Mehmet Dışçeken, those who lost their relatives in the earthquake and party lawyers attended.

During the break after the victims and their lawyers were heard, it was seen that Dışçeken left the hall due to another case.

ADDITIONAL DEFENSE SHOULD BE TAKEN FOR ALL 8 DEFENDANTS DUE TO "POSABLE INTENTION" CRIME

Speaking after the statements of the interveners, their lawyers stated that they agreed with the prosecutor's opinion, which included accusations of "killing with possible intent" and "injuring with possible intent" against the defendants Sami Kervancıoğlu, Mustafa Pekel and Ertan Danacı.

The lawyers demanded that additional defenses be taken from all other defendants on the charge of "killing and wounding with possible intent" and that the defendants who were not detained be arrested.

"PARENT IS A MIGRANT" REMINDER

Victim lawyers stated that public officials did not attend the hearings with the understanding that "Nothing will happen to us anyway", and demanded deterrent punishments, adding that they did not want new casualties due to renovations in the next earthquake.

Recalling the contractor Veli Göçer, who was detained for a while after the earthquake on August 17, 1999, an intervenor's lawyer said, "With the decision you make, the future will be shaped, and the mentality of 'those who do it gets away with it' will be put to an end."
