The crime of dereliction of duty refers to the behavior of state agency staff who, in the process of exercising their powers or performing their duties, abuse their powers, neglect their duties or engage in malpractice for personal gain, hindering the legal, fair and effective execution of official duties of state agencies, damaging citizens' trust in the objective, fair and effective execution of official duties of state agencies, and causing heavy losses to public property, the interests of the country and the people. The broad sense of dereliction of duty crimes also includes crimes of dereliction of duty by personnel of state-owned companies, enterprises, and public institutions.
The cases released this time cover dereliction of duty crimes committed by staff of state agencies and state-owned companies, enterprises, and institutions, and involve key areas such as high-quality development, state-owned asset protection, ecological environment protection, and road engineering construction.
The trial court shall, based on the facts, nature, circumstances and harm to society of each defendant's crime, impose a sentence within the statutory sentencing range in accordance with the law. Those with severe or upgraded punishment circumstances shall be severely punished in accordance with the law.
In the "Cao bribery and abuse of power case", Cao, as the municipal party committee secretary in charge, abused his power. In order to achieve political achievements as quickly as possible, he borrowed money to implement large-scale project construction regardless of local financial resources, causing huge losses and seriously affecting and restricting the sustainable development of the local economy and society. At the same time, Cao sought benefits for others and accepted bribes totaling more than 24.95 million yuan. The court decided to sentence him to 13 years in prison and fine him RMB 2 million for the crimes of abuse of power and accepting bribes.
In the "Li bribery and abuse of power case", Li, as the director of the Municipal Transportation Bureau in charge of highway construction, accepted requests from unscrupulous businessmen and abused his power in many aspects of the highway project, causing heavy losses to the interests of the country and the people. At the same time, Li also solicited huge bribes from others and was sentenced to death for accepting bribes with a two-year suspended execution. He was sentenced to nine years in prison for abuse of power.
