Now, the Kuomintang legislator Ye Yuanzhi has proposed three major amendments to the law targeting retired civil servants, military personnel and teachers, aiming to comprehensively Delete the current restrictions on retired military, civil and educational personnel re-entering public service or the government donating a certain percentage of funding to specific institutions that must stop receiving retirement pay, resurrecting the "double-pay fat cat" that was criticized more than 10 years ago, disregarding justice for generations, and compressing employment opportunities for young people.
Kuomintang legislators Ye Yuanzhi, Luo Tingwei and others proposed the "Draft to Delete Article 34 of the Service Regulations for Army, Navy and Air Force Officers and Non-Commissioned Officers". They want to delete the current pension or alimony for officers and non-commissioned officers who are re-appointed to public offices, administrative legal persons, legal entities with more than 20% of the government's original contribution, investment enterprises, etc., and whose monthly salary exceeds the maximum salary of the appointed first grade and the total of professional bonuses. The retirement salary will be suspended.
Furthermore, Ye Yuanzhi and others have drafted the "Draft to Delete Article 77 of the Civil Servant Retirement Pension Law" to delete the relevant restrictions on the current government agencies, schools, and groups that allow government budgets to remunerate retired civil servants, or corporate foundations and reinvested enterprises whose original government donations amount to more than 20% of the total assets. Those whose monthly salary exceeds the basic salary should stop receiving periodic pensions and related restrictions.
Ye Yuanzhi and others proposed the "Draft to Delete Article 77 of the Public School Teachers' Retirement and Severance Pension Regulations" to delete the current retired teachers who re-employed in public institutions, schools, government donation consortiums, and government-invested enterprises. Those whose monthly salary exceeds the basic salary will cease to receive monthly pension rights.
If the three laws proposed by Ye Yuanzhi are passed, that is, retirees from the military, public and education sectors will be able to receive full monthly pensions/retirement benefits at the same time, regardless of whether they hold public office again, are administrative legal persons, invest in government-invested enterprises, or receive current salary every month, which is equivalent to fully reviving the dual-salary fat cat system.
The anti-double-pay fat cat policy was enacted to prevent a few people from occupying multiple positions and resources.
Recall that on July 13, 2010, the Legislative Yuan amended and passed the "Public Service Retirement Act" on the third reading, officially incorporating the "fat cat clause" into the legal specification for the first time, thereby eliminating the phenomenon of receiving double salary. The legislative consideration at that time was to implement fairness and reasonable allocation of resources, to prevent retired public servants from receiving double salaries at the same time, to save the country's overall public funds, and to make a more reasonable allocation of limited pension resources; at the same time, taking into account social welfare and generational justice, by suspending the limit on monthly pensions, retirees were encouraged to release their vacancies, promote the flow of social human resources, and prevent a small number of people from occupying multiple positions and resources at the same time.
Ye Yuanzhi explained in the proposal explanation that in order to face the current wave of job shortages in the current environment, promote employment for the middle-aged and elderly, build a friendly workplace environment, make full use of the professional talents of retired civil servants to improve overall public service efficiency, guide the return of senior talents, and improve the allocation of human resources across the country, it is necessary to remove the current restrictions on re-appointment in public office.
