一条线索引出行业监管盲区
此前,杭州市临平区人民检察院发现某商场攀岩项目攀爬高度超标、保险绳索松动,存在安全隐患。经现场勘验、资质核验、对标国家技术标准、咨询行业专家,检察机关查实该场所存在无证经营、未配备专业技术人员、安全警示标识模糊、设施未定期检测等多项违法情形。
杭州市人民检察院研判后认为,该案并非个例,以此为契机将“护航安全出游——高危险性旅游体育行业安全监督”列为年度公益诉讼民生实事项目,统一立案标准、出台专项工作指引,该市检察机关同步开展专项监督。
针对高危旅游体育项目分布零散、隐蔽性强、传统监管易存盲区等痛点,杭州检察机关通过数字化手段筛查并赴现场逐一核实,一批潜藏的安全问题“浮出水面”。
部分商家无证经营或经营许可证过期,部分攀岩场地硬件达不到国标,游泳场馆救生员、安全设施配置不足,漂流、热气球等户外项目器具无合格证明,急救器械缺失、急救药品过期……检察机关通过全域排查把分散隐蔽的行业风险纳入监督视野。
多方协力闭环推进问题整改
为切实推动问题落地整改,守护公共安全,检察机关主动对接行政主管部门,凝聚多方监管合力,构建线索处置、联合整治、跟踪检验完整闭环。
作为专项监督重点地区,临平区人民检察院推动成立专项整治行动小组开展拉网式排查,约谈经营主体40余户,督促整改隐患50余处,推动7家经营主体补办审批手续,规范8份游泳场馆外包转包协议,并将密室逃脱、剧本杀等新兴文娱项目纳入检查范围。
与此同时,杭州各地检察机关立足当地业态特点实施精准监督,推动游泳场所申办、续办经营许可证,配齐救生观察台、应急照明灯等安全设施;针对漂流、热气球、滑翔伞等山地旅游高危项目制发检察建议,隐患全部闭环整改;对相关违规企业立案处罚,并联合红十字会开展安全培训与应急演练。
整改不是“一督了之”。为防止问题回潮反弹,检察机关全面开展整改“回头看”,邀请行业专家、公益志愿者等对重点场所实地复检,逐项核验设备、资质、人员配置情况,确保隐患清零不反弹。
以案促治“办一案治一域”
办案不止于“案结事了”,更要实现“办理一案、治理一片、规范一域”的效果。为此,检察机关以整改促规范,补齐监管制度短板,推动安全治理从“事后救济”向“事前预防”转型。
在个案推动下,临平区人民检察院联合相关部门会签《高危险性体育项目信息共享机制》,明确线索移送、信息互通、资源共享路径,打破部门之间的数据壁垒,实现高危项目常态化、动态化监管。
同时,杭州多地建立起“日常巡查+专项排查+隐患回头看”监管体系,细化设备定期检验、突发事件处置等全流程标准,推动安全治理从单点整改向全域防控升级。
