New Regulation Following the Constitutional Court's Indefinite Alimony Decision

The Constitutional Court annulled the indefinite alimony practice on June 4. For this reason, the AK Party will present the 13th judicial package, which includes the new alimony regulation, to the Parliament in October.

HOW MANY YEARS WILL ALMOST BE PAID? According to the new regulation, alimony will be given to the woman for at least 5 years, even if the marriage lasts 6 months or 1 year. Alimony will be paid for half the period from the date of marriage to the date of filing for divorce. If the woman is unable to work or is of advanced age, the court may decide on longer-term alimony. If older women do not apply to the court within 1 year after the alimony period ends, they will not be able to request an additional alimony period. It may be decided that the alimony, which is initially paid monthly, will later be paid as a lump sum.

AFTER THE REGULATION IS LAW, ALIMONY WILL NOT BE CUT IMMEDIATELY After the regulation becomes law, alimony payments previously filed and finalized in divorce cases will not be cut immediately. Alimony will be paid to these people for 1 more year. Measures will also be taken to reduce the number of contested divorce cases.

AFTER DIVORCE, IT WILL COME TO ALMOST AND CUSTODY CASE First, the couples' divorce case will be heard and a separation decision will be made. Then, alimony, property division and custody, which are among the factors that cause the case to take longer, will also be heard in the cases.

TIMELINE FOR PROPERTY SHARING WILL BE REDUCED FROM 10 YEARS TO 5 YEARS Cases and matters arising from family law will continue during the judicial recess. The statute of limitations for cases arising from the distribution of property will be reduced from 10 years to 5 years.
