Critical Detail in the SSI Control Examination Process: Pensions Are Not Paid Retroactively

A critical detail has emerged regarding the control examination process for pensions granted by the Social Security Institution (SGK) to disabled and invalid insured people or their eligible relatives. SSI Chief Expert İsa Karakaş warned that failure to carry out control examinations on time could lead to serious financial losses.

PAST PAYMENTS MAY NOT BE PAID Karakaş stated that the most critical situation occurs if the control report is received after three months. If the person delays the control examination for more than three months, the pensions deducted during this period will not be paid retroactively, even if the disability status continues. In this case, the new month can be reconnected from the beginning of the month following the new report date.

SGK SENDS A REFERRAL DOCUMENT BEFORE THE CHECK DATE SGK sends a referral document to the beneficiaries in an official letter at least three months before the control examination date. If only the year and month are specified in the control decision, the first day of the relevant month is considered the official control date. Karakaş stated that hospital procedures should be started without delay after the notification letter is received, and that time is of great importance in order to avoid loss of rights.

THE DATE OF RECEIVING THE REPORT CHANGES THE STATUS OF THE SALARY The date on which the control report is received determines whether the pension will continue or not. If the report is received within three months before the control date and it is determined that the disability status continues, there will be no deduction from the pension. If it is determined during the examination that the disability has ended, the pension is deducted in the payment period following the control date. However, the amounts paid until that date are not requested back from the person.

IF A REPORT IS RECEIVED WITHIN THREE MONTHS, THE ACCUMULATED SALARY IS PAID If the report is received within three months following the control date, the monthly payment is temporarily suspended as a precautionary measure. If the report is approved by the institution, the pensions accumulated from the date of deduction are paid to the beneficiary in a lump sum.

IN WHAT CASES IS CONTROL INSPECTION MADE? A follow-up examination is performed to determine whether the person's illness or disability continues. The file may be re-examined as a result of the SSI health boards deeming it necessary, the insured person reporting that their health condition has deteriorated, a deficiency being detected in the first report, notifications from third parties or inspections by inspectors. Those who receive permanent disability income and disabled children can also be subjected to this control mechanism regularly.
