China News Service, Nanning, September 24 (Chen Qiuxia) The reporter learned from a press conference held by the Standing Committee of the People's Congress of the Guangxi Zhuang Autonomous Region on the 24th that on the same day, the 27th meeting of the Standing Committee of the 14th People's Congress of the Guangxi Zhuang Autonomous Region voted to pass the Anti-Domestic Violence Regulations of the Guangxi Zhuang Autonomous Region (hereinafter referred to as the Regulations).
Zhao Wulin, deputy secretary-general of the Standing Committee of the People's Congress of the Guangxi Zhuang Autonomous Region, introduced at a press conference that the regulations include six chapters and 40 articles, with the main line of building a full-chain anti-domestic violence legal system of prevention, treatment, rescue, and protection, and will be officially implemented on December 1 this year.
The regulations clearly define the concept of domestic violence and refine it into types such as physical infringement, restriction of personal freedom, mental infringement, and economic control, which mainly include: infringements such as beating, binding, mutilation, freezing, starvation, and sexual assault; infringements such as detention and restriction of external exchanges; infringements such as stalking, harassment, frequent verbal abuse, intimidation, threats to personal safety, insults, slander, and dissemination of privacy; infringements such as abnormal economic control, deprivation of property, and other domestic violence behaviors stipulated in laws and regulations. At the same time, the regulations stipulate that violence committed between people living together other than family members shall be implemented with reference to the provisions of these regulations to expand protection coverage.
The regulations clarify the responsibilities of all parties and build a multi-departmental collaborative working system. It stipulates that people's governments at or above the county level should establish and improve an anti-domestic violence work system with the collaborative participation of multiple departments, and clarify the organizational and coordination responsibilities of institutions responsible for women and children and the specific responsibilities of each relevant department.
The regulations establish first responsibility and joint working mechanisms to improve the handling mechanism of domestic violence. Xiao Yuangui, deputy chairman of the Legislative Affairs Committee of the People's Congress of the Guangxi Zhuang Autonomous Region, introduced that the regulations clearly stipulate that the relevant departments and units that first receive domestic violence complaints, reports or requests for help should accept, follow up and make referrals in accordance with their job responsibilities, and must not shirk the responsibility. Major domestic violence cases that involve the responsibilities of multiple departments and units or domestic violence cases that have a negative social impact should be handled jointly with other relevant departments and units. This system aims to solve the problem of "skipping the ball" encountered by victims when asking for help in practice, and ensure that victims are "managed and not pushed back" when asking for help.
The regulations clarify the handling procedures of the public security organs, stipulate that the public security organs should dispatch the police promptly after receiving domestic violence reports, and detail specific handling measures.
The regulations refine the warning letter system, clarify the six situations in which a warning letter should be issued, and stipulate the procedures for submission and inspection; detail the requirements for personal safety protection order application, application on behalf of others, protective measures, delivery and assistance in execution.
