Seo Young-kyo, "The claim that the special prosecution bill for fabricated indictments is a 'presidential conflict of interest' is nonsense."

Seo Young-kyo of the Democratic Party of Korea, chairman of the Legislation and Judiciary Committee of the National Assembly, refuted point by point the controversy surrounding the president's conflict of interest and the investigative rights of dispatched prosecutors surrounding the 'Special Prosecution Act on Manipulated Indictments (Plan)', calling it 'nonsense.'

Rep. Seo wrote on Facebook, "The president's conflict of interest is nonsense," and "The president is not the subject of the special prosecutor's investigation. The targets of the investigation are Prosecutor Yoon Seok-yeol, the National Intelligence Service, and the Board of Audit and Inspection. These are the people who manipulated, concealed, and created false official documents during the investigation and audit process."

The opposition party has pointed out that President Lee's appointment of a special prosecutor to look into President Lee Jae-myung's case could be a conflict of interest.

Rep. Seo refuted, “Even when Park Geun-hye was the subject of an investigation into ‘government corruption,’ she appointed ‘Special Prosecutor Park Young-soo.’”

Rep. Seo explained, “The question ‘Is it okay for prosecutors to participate in the investigation when investigation and prosecution are separate?’ is ignorant without knowing the amendment to the Criminal Procedure Act.” He explained, “According to the revised Supplementary Provisions of the Criminal Prosecution Act, the special prosecutor of the National Election Commission currently under investigation and the newly created special prosecutor are to be investigated by the special prosecutor and assistant special prosecutor.”

Rep. Seo said, "It is also nonsense to say that there is a risk of conflict of interest if a prosecutor who is the subject of an investigation participates in the investigation." He added, "It is a case of a prosecutor who is not the subject of the investigation participating in the investigation. In the past, prosecutors including the 'Benz prosecutor' investigated prosecutors."

Rep. Seo responded to the claim by some that the special prosecution for fabricated indictments is the largest special prosecution in history, saying, "(The maximum number of special prosecutors for fabricated indictments) is 309, which is smaller than the special prosecutor for the rebellion (317)," and added, "The period is the same as other special prosecutors, 90 days (maximum 200 days)."

He said, "Some of the People's Power Party and Han Dong-hoon are likely to be targets of investigation," and "Criminals who manipulated investigations and indictments are trying to block the special prosecution, but I warn you that this may also become a target of investigation."
