Notice from the General Office of the Ministry of Industry and Information Technology on strengthening the network access management of intelligent terminal equipment
Department of Industry and Information Technology Information Management [2026] No. 42
Relevant units:
Smart terminals refer to telecommunications terminal equipment such as mobile phones, tablets, and wearable devices that are pre-installed with smart phones. In order to thoroughly implement the spirit of the 20th National Congress of the Communist Party of China and all 20th plenary sessions, coordinate development and security, promote the healthy and orderly development of intelligent terminals, and effectively safeguard the legitimate rights and interests of users, in accordance with the "Cybersecurity Law of the People's Republic of China", "Data Security Law of the People's Republic of China", "Personal Information Protection Law of the People's Republic of China", "Anti-Telecommunications Network Fraud Law of the People's Republic of China", "Telecommunications Regulations of the People's Republic of China", "Telecommunications Equipment Network Access Management Measures" and other relevant laws, regulations and rules, the relevant matters are hereby notified as follows.
1. Work tasks
(1) Carry out intelligent agent and terminal adaptation. An intelligent agent is an intelligent system with autonomous perception, memory, decision-making, interaction and execution capabilities. Intelligent agent developers should strengthen the verification of adaptation to terminal devices, strengthen the management of authority invocation, communication capabilities, network and data security, user rights and task execution, etc., to ensure compliance with regulatory requirements and user expectations, and ensure the compatible and stable operation of intelligent agents. Smart body developers should standardize smart body information management, disclose the adaptation verification list to users on the product settings page, list the terminal models and operating system information that have completed adaptation, and protect users' right to know and choose. Before an intelligent agent is put on the application distribution platform, its developer should submit the adaptation verification status to the application distribution platform.
(2) Improve the network access management of intelligent terminals. Carry out risk assessment, improve the detection mechanism for telecommunications equipment entering the network, and refine the requirements for special provisions. Smart terminals such as mobile phones, tablets, and wearable devices with pre-installed smarts must conduct smart body adaptation verification in accordance with relevant standards during network access detection; carry out fraud risk security assessments and anti-fraud capability pre-evaluation of smart terminals in accordance with the law, and implement important communication work requirements. The intelligence used on the terminal should be equipped with a unique identity code with reference to the national standards of the intelligence interconnection series. Terminal manufacturers should ensure the consistency of intelligent terminals before and after obtaining network access licenses. If there are major changes in intelligent terminals, the terminal manufacturer should report to the Ministry of Industry and Information Technology and carry out network access testing as required.
(3) Strengthen intelligent embodiment network upgrade management. Terminal manufacturing enterprises that carry out intelligent embodiment network upgrades through online upgrade push (OTA) and other methods should submit the existing network upgrade plan to the Ministry of Industry and Information Technology, clarify the existing network upgrade time, scale, user groups, business scenarios, service content, business operation model, network and data security measures, anti-telecom network fraud measures, etc., and simultaneously complete important communication work. After the terminal manufacturer's existing network upgrade is completed, it must submit an existing network upgrade report to the Ministry of Industry and Information Technology. The Ministry of Industry and Information Technology organizes expert evaluation and solicits opinions before officially providing services to users.
(4) Improve the intelligent agent distribution management mechanism. The application distribution platform should encourage application developers to actively declare whether they agree to the call of the agent through electronic signatures. Without the declaration of consent, the agent shall not be forced to call the application. The application distribution platform should disclose the intelligent agent adaptation verification list to users on the distribution page, and should not provide users with intelligent agent download and installation services for incompatible device models. The application distribution platform should strengthen the inspection of the adaptation verification of existing agents, and take measures such as rectification within a time limit and removal from the shelves for agents that have not completed the adaptation verification.
2. Work requirements
(1) Strengthen market supervision. The Ministry of Industry and Information Technology and the Communications Administration Bureaus of various provinces, autonomous regions, and municipalities directly under the Central Government have strengthened organization, coordination, supervision and inspection, established routine and special inspection mechanisms, interpreted policies, smoothed channels for complaints and reports, dealt with violations of product listings in accordance with the law, and effectively safeguarded the legitimate rights and interests of users.
(2) Strengthen the implementation of responsibilities. All relevant entities must earnestly fulfill their responsibilities, strictly implement the tasks of this notice, and conscientiously organize and carry out intelligent terminal network access detection, adaptation verification, existing network upgrades, distribution management, etc. Refine the division of tasks, clarify work goals, strengthen internal management and technical support, and ensure that all links are implemented in place.
(3) Consolidate capacity building. The Ministry of Industry and Information Technology has organized the China Academy of Information and Communications Technology and other relevant institutions to continue to deepen research on intelligent terminal technology and consolidate capabilities such as new technology analysis and testing verification, event monitoring and analysis, problem judgment and resolution, scenario research and application, etc. Organize and build an adaptation library for agent versions and terminal models, accelerate the development of standards related to adaptation verification, accelerate the construction of an agent trusted identity system and management platform, and continuously improve terminal technology and innovation levels.
