Şüpheliler, savcılıkta saatlerce ifade verdi. İfade işlemlerinin tamamlanmasının ardından Fatma Betül Sayan Kaya tutuklanması talebiyle, eşi İlyas Kaya ile eski SPK Başkanı İbrahim Ömer Gönül ise adli kontrol talebiyle mahkemeye sevk edildi. Mahkeme Fatma Betül Sayan Kaya’nın “Sermaye Piyasası Kanunu’na muhalefet” ile “suç işlemek amacıyla kurulan örgüte üye olma” suçlarından tutuklanmasına, İlyas Kaya ve İbrahim Ömer Gönül’ün ise adli kontrol şartıyla serbest bırakılmasına karar verdi.

Öte yandan savcılık sevk yazısında, Fatma Betül Sayan Kaya’nın hisselerini fonlarla ilgili tasfiye kararından bir gün önce; 16 Eylül 2026’da Tera Yatırım üzerinden virman yoluyla sattığına dikkat çekildi. Normal şartlarda T+2 takas sistemine tabi olan hisse satışlarında bedelin iki iş günü sonra hesaba geçtiğine dikkat çekilen sevk yazısında, Kaya’nın işleminin T+0 şeklinde gerçekleştirilerek bakiyenin aynı gün hesabına aktarılmasının şüpheli bulunduğu belirtildi.
