O desembargador Luiz Fernando Vaggione, relator do processo, disse que as postagens não se tratavam de “simples manifestação genérica de opinião” e reforçou também que a liberdade de expressão não abrange discriminação pública e incitação de violência, sobretudo contra grupos vulnerabilizados.
“Ainda que parte dos vídeos tenha sido uma republicação do conteúdo de terceiros, seu compartilhamento, seguido de manifestações pessoais de concordância e dizeres discriminatórios, inviabilizam a pretendida absolvição”, disse o relator.
A decisão da Justiça teve votação unânime para a condenação decretada pela 2ª Vara Criminal de Presidente Prudente (SP), com pena fixada em dois anos de reclusão, em regime inicial aberto, substituída por prestação de serviços comunitários.
