The first hearing of the case of the arrested defendant Uğur Mersinli, the father of the deceased attacker, and the detained defendant Peyman Pınar Mersinli, whose mother was arrested, regarding the school attack in Kahramanmaraş in which 1 teacher and 9 students lost their lives and 15 students were injured, has been completed.
At the hearing, which started yesterday at the Kahramanmaraş 3rd High Criminal Court and passed midnight, the defendants attended via the Audio and Video Information System (SEGBİS) from the prison where they were detained.
Parties' lawyers, members of the Grand National Assembly of Turkey Şanlıurfa and Kahramanmaraş School Incidents and Digital Risks Investigation Commission, AK Party MPs İrfan Karatutlu and İsa Messi Şahin, and Provincial Director of National Education Turan Akpınar were present at the hearing.
Families attended the hearing wearing t-shirts with photos of their lost loved ones. Psychologists were heard as witnesses at the hearing, which started yesterday with the defense of the defendants and continued with the statements of the complainants and the statements of the lawyer. D.Ö, a psychologist working at the Police Department, stated that his job description is to provide psychological support to the members of the organization, their spouses and children, and added that Uğur Mersinli regularly came to the meetings for his child's exam, but ended the meetings as of December.
Stating that they met Mersinli a week before the incident and asked about Aras, D.Ö said, "We are going to the psychiatrist, we are happy," and stated that he was diagnosed with autism, and we broke up." he said.
Psychological counselor H.G. Stating that he met with the mother, father and child on March 7, he continued as follows:
"I asked routine questions, in my private interview with the child, he said that he used technology a lot and that he was a lively playmate. I informed the family about this issue, and in the second interview, he explained his poor public relations and said that he did not like school. He did not volunteer for the third study, so I talked to his family. I determined that there was a problem with his identity orientation and invited the mother to convey this situation. Her mother said that she knew about the issue. I said that a psychiatric evaluation would be appropriate. They stated that they had gone to a psychiatrist before, and I said that they could take them there again."
Psychological counselor F.B. Stating that he was doing psychological counseling in a private clinic, he stated that the family told him about his child's exam problems and said, "Then the family asked us, 'Are you going to register?' When he asked, we informed the family about this. While paying the bill, I said, 'An invoice will be issued, so we need to get your ID information.' Then the family said 'don't issue an invoice', so we took action before a record was created." he said.
"THE CHILD GOT STOCKED WHEN HE ASKED QUESTIONS ABOUT HIS FAMILY"
Psychologist Y.G. Stating that İsa Aras from Mersin approached him because he could not make friends, he said, "When I asked Aras why are you having problems with your friends, he said that his friends and his peers were ignorant. When I asked Aras questions about his family, the child got stuck and could not speak. I met him once and there was no meeting again." he said.
CRYING CRISIS
E.İ., the guidance teacher of Ayser Çalık Secondary School, where the incident took place. Reminding that he had known de Aras since the 5th grade, he continued as follows:
"In the 7th grade, he was having problems, especially in making friends. I talked to him about this. Then I talked to the family, I asked the child to get advice from a psychologist. In the 8th grade, he choked himself with his school bag and tried to strangle himself. I asked him about this, and he told me that he was bored with the lesson. I reported this to the family, explained his problems, and told him that he should stay away from technology. The family told me that they went to the police and a private psychologist. Aras usually came to me with crying spells. He was very lonely in his relationships with friends, which meant "It was increasing day by day."
Doctor N.E.S. from Kahramanmaraş Sütçü İmam University Faculty of Medicine Hospital. He stated that he wanted an examination and said:
"While the ECG was being taken, we noticed that there were scratches on her arms. When I talked to the nurse, she said that she had done it last night, that she was bored at times and that she had damaged it with a pencil and pencil sharpener. Then, I gave instructions to open a forensic case and referred her to a child psychiatrist. Then the child psychiatrist came, I completed the forensic case file with her statements and my observations. I said that I would not discharge her before the parent arrived, and I discharged her when the guardian arrived. When her father came, he said that he was the chief inspector, and when I told him that I was a doctor, he said 'Thank you' he said.
The hearing prosecutor requested the defendants' continued detention.
In its interim decision, the court decided to continue the detention of father Uğur Mersinli and to release mother Peyman Pınar Mersinli, and postponed the hearing to December 4.
Relatives of those who died in the attack reacted to the evacuation decision.
THE DECISION WILL BE APPEALED
Özcan Kara, the lawyer of teacher Ayla, who lost her life in the attack, reacted to the release of mother Mersinli, in a statement to journalists in front of the courthouse after the decision, claiming that the court violated its impartiality and right to a fair trial.
Stating that they will object to the decision without wasting time, Kara stated that they will also request a recusal judge for the members of the delegation who support the release decision.
Kara claimed that Mersinli's mother caused a chain of negligence and described the court decision as a "legal scandal".
Abdullah Cevdet Yeşil, father of Adnan Göktürk Yeşil, who lost his life in the attack, stated that they are fighting to prevent such pain from happening again in Türkiye and argued that the law has been shaken at this point.
Yeşil, who wants the issue to be addressed as families who buried their 10-11 year old children, noted that their only wish is for rights and law to be met.
Bayram Nabi Şişik's mother, Mine Şişik, also stated that the case had been going on for about 15 hours and that all the witnesses had told about the mother's negligence during this time and said, "Was the woman who was so neglectful released with the words 'I have two daughters, they are alone at home'? She raised one of her children as a terrorist, we buried our children. Will someone who raised a murderer support her daughters outside?" he reacted to the decision.
FROM THE INDICTMENT
In the 43-page indictment prepared by the Kahramanmaraş Chief Public Prosecutor's Office, the detained defendant Uğur Mersinli was accused of "killing with possible intent" against 10 people, "injuring with possible intent" of different qualities against 15 people and "violating the Law No. 6136 on Firearms, Knives and Other Tools", and the detained defendant Peyman Pınar Mersinli was accused of "causing the death and injury of more than one person through conscious negligence." He is requested to be punished for the crime of "causing".
In the armed attack carried out by student İsa Aras Mersinli at Ayser Çalık Secondary School in Kahramanmaraş on April 15, teacher Ayla Kara and 9 students lost their lives and 15 students were injured.
