On March 6, Voyles, who was homeless at the time, admitted that he entered Touchstone through a damaged garage door for shelter and, while inside the business, took a drill bag and intended to steal it.

According to KPTV, Grant was working in the back room at the time and found Voyles trespassing inside the store.

Voyles said he immediately apologized and Grant responded by throwing items at him, so he had to run for the door. Adding that he bought a pair of bolt cutters on the road to defend himself, Voyles said that he was shot after he came across a locked door while trying to escape.

The lawsuit also alleges that after grabbing the bolt cutter, Voyles pulled out Grant's gun and fired at him multiple times without warning, saying "You're going to die" and then shooting him again at close range in the chest.

Grant rejected Voyles' testimony in a March interview. He claimed he found Voyles upstairs in his office and followed him to the back of his warehouse, where Voyles became aggressive.

"I knew right away that he was ready to attack me," he said. "He grabbed the bolt cutter and lifted it up and started coming towards me... my life was in total danger."

He said he repeatedly warned Voyles to get on the ground, but the intruder refused to lie down.
