Scotland's high court trial backlog has nearly tripled to about 1,000 cases, driven by complex organised crime and historic sex abuse cases. Audit Scotland reports this increase is causing system-wide pressure and delayed justice for all parties involved. Successful prosecutions in such cases have led to longer prison sentences, contributing to a record-high prison population despite emergency early releases.

Debbie Adams of Victim Support Scotland highlights the human impact, noting victims must keep traumatic experiences fresh in their minds for extended periods, with a significant risk of witness attrition. Meanwhile, the accused face prolonged uncertainty affecting their employment and home life.

Audit Scotland's Stephen Boyle praises the transformation programme but expresses concern over the lack of evaluation and public reporting, making it difficult to assess what strategies are effective.

A project, summary case management, has shown success in reducing summary trial backlogs (from over 30,000 to 9,000) through early evidence disclosure, prompt discussions, and proactive judicial involvement. Discussions are ongoing to adapt this approach to more serious (solemn) cases.

Defence lawyer Tony Lenehan KC attributes the increased trial load to improved reporting of serious crimes, anticipating the justice system will adapt. The SCTS acknowledges the challenge and plans to continue improvements, seeking sustainable resourcing.
