TRE-DF orders removal of video by José Roberto Arruda that accused candidate for vice-governor of receiving R$6.3 million

The Regional Electoral Court of the Federal District (TRE-DF) ordered José Roberto Arruda (PSD) to remove from Instagram a video in which he states that Gustavo Rocha, candidate for vice-governor on the Celina Leão (PP) ticket, had received R$6.3 million from banker Daniel Vorcaro. The preliminary decision was signed this Saturday (6) by assistant judge Rafael Moreira Mota.

In its representation, the Propósito e Ação coalition maintained that the publication disseminated false and out-of-contextual information.

In a note to g1, José Roberto Arruda stated that he complied with the court decision and removed the video from the air.

The candidate challenged the injunction and said he sees a contradiction in the fact that, according to him, opponents use artificial intelligence resources in electoral advertisements against his candidacy, while his campaign is prevented from disclosing information that, according to Arruda, was published by the press.

"The video was taken down. What surprises me is that they even use artificial intelligence to create a montage that is on the air, according to me, on radio and TV networks during election time. And I can't present facts published by the press? They want to represent the right, but they are a right that defends censorship and is against freedom of expression of the truth.", asked Arruda.

When analyzing the case, the magistrate concluded, in a preliminary decision, that the documents presented indicate that the R$6.3 million mentioned in the video had been allocated to other law firms, and not to the firm of which Gustavo Rocha was a partner.

The judge also noted that the reports cited in the publication do not indicate an investigation against the candidate for vice governor.

According to the decision, the post goes beyond the limits of freedom of expression and has the potential to harm Gustavo Rocha's image among the electorate. The judge understood that there was evidence of negative electoral propaganda based on a fact known to be untrue.
