A l'issue d'un premier procès en avril 2022, Coline Berry-Rojtman a d'abord été condamnée en première instance par le tribunal d'Aurillac (Cantal) à 2 000 euros d'amende pour diffamation à l'encontre de Jeane Manson et à lui verser 20 000 euros de dommages et intérêts, ainsi que 5 000 euros au titre de ses frais de justice.

La cour d'appel de Riom (Puy-de-Dôme) avait ensuite confirmé cette condamnation, augmentant les frais de justice dus à Jeane Manson de 5 000 euros, soit 10 000 euros au total. En juillet 2024, une deuxième cour d'appel, celle de Lyon, a toutefois relaxé Coline Berry-Rojtman, après l'annulation par la Cour de cassation du premier arrêt.

Cette décision avait été contestée par Jeane Manson, qui avait alors saisi à son tour la plus haute juridiction : la Cour de cassation est donc de nouveau intervenue en décembre 2025, annulant finalement en partie la relaxe dont avait bénéficié Coline Berry-Rojtman, renvoyée, encore une fois, vers la cour d'appel de Lyon, mais uniquement pour ses propos tenus sur BFMTV.

Les juges lyonnais ont mis un point final à cette interminable procédure par leur arrêt rendu le 22 septembre, relaxant également Coline Berry-Rojtman sur ce volet. Contactée par franceinfo, elle dit ressentir "un immense soulagement".

"Pendant presque cinq ans, j'ai été attaquée pour avoir dénoncé les abus que j'ai subis quand j'étais enfant. (...) Moi, j'ai été jugée, mais mon père et Jeane Manson ne le seront jamais."

L'enquête visant l'acteur et son ex-compagne, accusés d'inceste, a effectivement été classée sans suite le 31 août 2022 pour cause de prescription. "Alors oui, une injustice s'arrête. Mais la justice, elle, n'a pas eu lieu", déplore la quinquagénaire, devenue psychothérapeute.

Coline Berry-Rojtman avait été invitée à témoigner au printemps dernier devant la commission d'enquête de l'Assemblée nationale portant sur les violences sexuelles incestueuses, où elle avait réitéré ses accusations contre son père, relatant "des viols répétés, presque chaque week-end".

Son avocat, Patrick Klugman, considère qu'elle "a vécu une campagne de calomnie destinée à l'écraser et l'engloutir et dont le principal instrument était la plainte de Jeane Manson". "Au terme d'un trop long combat judiciaire, il n'en reste plus rien, si ce n'est le courage de Coline d'avoir affronté ses démons et de s'être battue contre ceux qui voulaient la faire taire", ajoute-t-il auprès de franceinfo.

Jacques Verdier, l'avocat de Jeane Manson, précise ne pas avoir fait de pourvoi en cassation pour sa cliente, ce qui signe donc l'arrêt de la procédure. Il maintient que l'intention de Coline Berry-Rojtman était bien de "nuire" à son ancienne belle-mère, alors que Jeane Mason n'a selon lui "jamais accepté qu'une enfant se livre à des attouchements imposés par son père sur son propre corps et sur le corps de son père".
