China News Service, Haikou, November 4 (Reporter Wang Xiaobin) At the "Hainan Free Trade Port Policy Interpretation" series of press conferences held on November 4, Wang Jingyi, a second-level researcher at the Legislative Division of the Hainan Provincial Department of Justice, interpreted the overall legislative ideas of the "Hainan Free Trade Port Urban Renewal Regulations" (hereinafter referred to as the "Regulations").
Wang Jingyi said that in response to practical shortcomings such as an imperfect planning implementation system and insufficient factor protection in urban renewal work, the Regulations have carried out institutional innovation in the field of land use, clearly supporting mixed development and spatial composite utilization of existing land, and setting up institutional arrangements such as incentives for floor area ratio optimization, transfer of planning indicators across plots, and renewal of land use terms to remove institutional obstacles to urban renewal.
Wang Jingyi introduced that the "Regulations" are a basic regulation in the field of urban renewal in Hainan Province. During the legislative review process, the Provincial Department of Justice insisted on the unity of reform and the rule of law, and mainly grasped legislative ideas from three aspects.
The first is to adhere to a problem-oriented approach and solve outstanding problems in practice in a targeted manner. In addition to efforts in land element protection, the Regulations also strive to improve the full-chain planning implementation system. Wang Jingyi said that the new regulations clarified a full-chain system that is based on urban physical examination assessment and connects special planning, area planning, annual plans, and project implementation plans. At the same time, the legislation has clarified the responsibility system for the overall leadership of the people's governments at or above the county level, the heads of the housing and construction departments, and the coordination of various relevant departments, and established a co-construction, co-governance and sharing mechanism with the participation of property rights holders, market entities, and the public.
The second step is to elevate mature practical experience into a legal system. Wang Jingyi pointed out that the "Regulations" establish approval mechanisms such as short-term acceptance, parallel processing, notification and commitment, and build diversified fund guarantee channels of fiscal investment, financial support, social capital participation, and self-raised by rights holders, aiming to improve the efficiency of project approval and implementation through a solidified system.
Finally, based on the positioning of the free trade port, we must coordinate institutional regulations and reform and innovation. Wang Jingyi said that while adhering to the unified bottom line of the rule of law, this legislation gives full play to the legislative advantages of the free trade port. In addition to diversifying the land supply model and mixed development of existing land, it also strengthens the supervision of fire protection, earthquake resistance, and project quality and safety in terms of overall development and safety, standardizes the entire process management of urban renewal, achieves an organic connection between legislative decision-making and reform decision-making, and uses high-quality local legislation to lay a solid legal foundation for Hainan's urban renewal.
