The New Taipei District Court of first instance found Wang Dalu not guilty of unauthorized checking of Chen's personal information. Wang Dalu and his girlfriend were sentenced to six months in prison for unauthorized checking of Pan's relatives. The case was appealed and the High Court opened today. Wang and Que still pleaded not guilty. Wang Dalu emphasized that he only established a group for his girlfriend and You Xiangmin and did not participate in the discussion. Liu Jurong admitted that he had committed a crime.
According to the prosecutor's investigation, Wang Nan was dissatisfied with Chen Nan for receiving money but not handling the issue of exemption from military service and then lost contact. He asked You Nan for help. In February last year, You took Wang with you and asked Yu's friend Liu for help. Liu posted a false inquiry reason to help inquire about Chen Nan's personal information and passed it to Wang through You Nan.
The first-instance New Taipei District Court collegial bench held that although Wang Dalu, You Xiangmin and criminal police officer Liu Jurong had illegally used Chen Nan's personal information, they could not prove that they had subjective intentions to profit or harm the interests of others, so they were acquitted. Liu Nan was also sentenced to one year and April in prison for checking personal information for false reasons and leaking it.
In addition, Wang Dalu, because his girlfriend Que Muxuan was defrauded by Pan Nan, formed a WeChat group with Que and You "Lost! Must get it back!" to recover the money. You then asked Chen Zijun to help obtain the personal information of Pan Nan's brother and sister, and appointed someone to collect the debt at his residence. The New Taipei District Court found Wang, Que, You, Chen and others guilty. Among them, You, Chen and others were sentenced to three months in prison for settlement and compensation. Wang and Que were each sentenced to six months in prison without settlement and compensation.
After the case was appealed, the High Court opened a preparatory court today. Wang Dalu still maintained his innocence. He pointed out that he asked his friend You Xiangmin to help his girlfriend who was defrauded find Pan Nan. Since his girlfriend and You Nan did not know each other, he set up a WeChat group for the two to contact him. However, he did not participate in the subsequent discussions, nor did he participate in the illegal use of personal information.
As for the personal information case of Chen Zhiming, who was acquitted in the first instance and was appealed by the prosecutor, Wang Dalu said that at that time he only asked his friends to help find "Xiao Hei". Later, when he learned that "Xiao Hei" had been imprisoned and served his sentence, he told his friends that there was no need to look for him anymore. Throughout the process, he only called the other person "Xiao Hei" without revealing his real name, and ordinary people had no way of knowing who "Xiao Hei" was.
Regarding the June sentence for assisting his girlfriend Que Muxuan in tracking down Pan Nan, Wang Dalu emphasized that his girlfriend wanted to find someone to recover the money because she was defrauded. He was only responsible for setting up a group to allow his girlfriend to directly contact You Nan. He did not actually participate in the discussion. For example, You Nan once sent a message in the group. He even replied "Thank you very much" 20 days later. He was just a polite thank you as a friend, and there was almost no other dialogue in the group.
Que Muxuan said that Pan Nan had originally promised to repay the loan, and later went to prison to serve his sentence. During this period, he also wrote to her from prison, but the two parties lost contact for a time in 2024. At that time, she thought that Pan Nan had been released from prison, so she asked You Xiangmin to help find someone. From the beginning to the end, she asked You Nan to find Pan Nan himself. She never asked to find Pan Nan's family members, nor instructed to obtain their family members' personal information. Therefore, the claim did not violate the personal information law.
Criminal police officer Liu Jurong pleaded guilty in court, saying that on February 13 last year, while serving in the Taipei City Criminal Investigation Team No. 3, he used the opportunity to investigate Chen Zhiming's personal information while investigating other cases, and told Wang Dalu to ask the judge for a lighter sentence.
The appointed judge informed the court that the case is scheduled to be heard again on December 23.
