Keelung City Councilor Zhang Haohan used a female assistant surnamed Chen as a fraud to collect assistant fees, and defrauded more than 780,000 yuan in public assistant subsidy by low-paying and over-reporting her salary. The Supreme Court today rejected the appeal. Although Zhang Haohan was given a suspended sentence and was determined not to go to jail, the suspended sentence was not as effective as the deprivation of public rights. The two-year deprivation of public rights took effect on the fixed date, and Zhang Haohan was dismissed from his position as a councilor with immediate effect.

In the first instance of the case, the Keelung District Court considered Zhang's guilty plea and the handover of the proceeds of crime, and sentenced him to 2 years in prison, suspended for 5 years, and deprived of public rights for 4 years for taking advantage of his position to defraud property. The high court of second instance commuted the sentence to 1 year and 11 months in prison, suspended for 5 years, and deprived of public rights for 2 years. Zhang Haohan served as a member of the Zhongzheng District of Keelung City for two terms. When he was elected for the first time, he hired Chen Nv as a publicly funded assistant. The two people knew that the funds allocated by the council were used to pay for publicly funded assistants and Spring Festival consolation money and were not allowed to be used for other purposes. However, Zhang used the method of "low salary and high reported salary" to fraudulently receive assistant subsidies. Chen Nv's monthly actual salary was about 35,000. Yuan, and later the salary was increased to 37,000 Yuan, but Zhang Haohan declared to the parliament that his salary ranged from 43,900 Yuan to 53,000 Yuan, and defrauded more than 670,000 Yuan in this way. The Keelung District Court sentenced Zhang to 1 year and 10 months in prison for two crimes of taking advantage of his position to defraud property, and a combined 2-year sentence. Considering that Zhang confessed and had returned the proceeds of crime, he was sentenced to five years of probation, paid 200,000 yuan to the public treasury, confiscated more than 780,000 yuan of criminal proceeds, and deprived of public rights for 4 years. Chen was sentenced to one year and four months in prison as an accomplice, suspended for four years, and deprived of public rights for two years. She did not appeal and was sentenced to death at first instance. Zhang appealed.

The High Court of Second Instance considered that Zhang confessed to the crime during the investigation, faced his wrongdoing and returned the proceeds of the crime, had a good attitude after committing the crime, and was deeply remorseful. His motive for the fraud was to seek substantial subsidies due to excessive expenditures on parliamentary activities. The sentence was reduced by 1 month, and the sentence was reduced to 1 year and 11 months in prison, suspended for 5 years, and the deprivation of public rights was reduced to 2 years. Zhang appealed, but the Supreme Court rejected it and the whole case was settled.
