北京市时代九和律师事务所高级合伙人闫兵指出,按照食品安全法第一百二十四条规定,生产经营不符合食品安全标准的食品,尚不构成犯罪的,没收违法所得和违法生产经营的食品、食品添加剂;违法生产经营的货值金额不足一万元的,并处五万元以上十万元以下罚款;情节严重的吊销许可证。
另外,消费者若购买了上述不合格食品的,按照食品安全法第一百四十八条规定,除要求赔偿损失外,还可以向生产者或者经营者要求支付价款十倍或者损失三倍的赔偿金;增加赔偿的金额不足一千元的,为一千元。
