The revised draft of the Food Safety Law is publicly soliciting opinions, involving AI supervision, campus food safety, etc.

The reporter learned today that the State Administration for Market Regulation has researched and drafted the "Food Safety Law of the People's Republic of China (Revised Draft for Comments)" and publicly solicited opinions from the public.

The main contents of the revision include five aspects:

The first is to strengthen smart supervision. Promote the application of "Internet + artificial intelligence" supervision, clarify that food production and operation enterprises should install monitoring equipment in key risk links of food production and operation, and connect real-time monitoring video information to the information system of the market supervision and management department of local people's governments at or above the county level; grant regulatory departments the authority to conduct off-site inspections such as Internet of Things monitoring and video inspections.

The second is to consolidate the main responsibilities. It stipulates that food production and operation enterprises and online food trading platform operators should be equipped with food safety directors and food safety officers in accordance with regulations, clarify job responsibilities, and strengthen training and assessment; food production enterprises are required to establish a food production process control record system; postal express enterprises are required to establish real-name collection and delivery, receiving and delivery inspection, and machine-passing security inspection systems; the commissioned production behavior is standardized and the qualifications of the entrusting party and the trustee are clarified.

The third is to strengthen supervision in key areas. A special section on "School Food Safety" will be added, the principal (director) responsibility system will be established, and a centralized meal companionship system for primary and secondary schools and kindergartens will be established; a special section on "Online Food Operations" will be added, hierarchical filing management will be implemented, and the main responsibilities of the platform, live broadcast room operators, live broadcast marketers, etc. will be clarified; it will be clarified that cross-border e-commerce enterprises bear the main responsibility for the safety of cross-border e-commerce imported food, food additives, and food-related products.

The fourth is to optimize the food safety management system. Expand the scope of food safety risk monitoring to include food additives and food-related products; incorporate infant and young child supplementary foods into special food supervision and implement record-keeping management; standardize food labels and commercial promotions, strictly prohibit false misleading; strictly enforce food inspection management, and standardize entrusted inspection activities.

The fifth is to improve the legal liability system. Set differentiated punishment ranges according to the types of violations; strictly implement "punishment for individuals" and impose penalties on responsible personnel who intentionally violate the law, are of a bad nature, and have serious consequences for their illegal behavior; supplement the penalty clauses corresponding to new obligations and increase the cost of violation; implement a food safety credit management system and implement cross-department punishment for breach of trust.

In the next step, the State Administration for Market Regulation will improve the revised draft based on the feedback from the public solicitation of opinions, and promote the revision and promulgation of the "Food Safety Law of the People's Republic of China" as soon as possible to provide a solid legal guarantee for regulating food production and operation activities, preventing and defusing risks, and strengthening supervision and law enforcement.
