Labor Party Gaziantep Deputy Sevda Karaca brought the claim that she gave a warning to Eğitim-İş Gaziantep Branch Personal, Legal and TİS Secretary Aycan Benli, who fulfilled her duty as union representation at the Gaziantep Provincial National Education Disciplinary Board meeting, to the agenda of the Turkish Grand National Assembly with a parliamentary question.
Karaca, who submitted a parliamentary question to the Presidency of the Turkish Grand National Assembly with the request of the Minister of Labor and Social Security Vedat Işıkhan to answer, said that at the meeting of the Gaziantep Provincial National Education Disciplinary Board, while the Education-İş Gaziantep Branch Personal, Law and TİS Secretary Aycan Benli, who attended the board to defend a union member under investigation, expressed her procedural objections and legal opinions, Deputy Governor Yakup Kılınçoğlu, who was the Chairman of the Board, said, "Be careful with your tone, you He claimed that he said, "I will not warn you again."
Drawing attention to the union rights guaranteed by Article 51 of the Constitution and the Public Servants' Unions and Collective Agreement Law No. 4688, Karaca stated that union representatives have the right to protect and defend the rights and interests of their members, and stated that voicing procedural errors in the disciplinary board and defending the rights of the member is a requirement of the union duty.
Karaca stated that the scolding and threatening attitude of a civil administrator in the position of chairman of the board towards the union manager means restricting the right to defense and suppressing union representation, and noted that it is unacceptable for public administrators to display a persistent and oppressive attitude towards union representatives exercising their constitutionally guaranteed rights.
Karaca asked the following questions to Minister Işıkhan:
-"Is there an investigation or investigation initiated by your Ministry regarding Gaziantep Deputy Governor Yakup Kılınçoğlu's intervention and statements towards the female union manager who fulfilled her duty as union representation at the Disciplinary Board meeting?
-Is it a legal right for union representatives to present objections to procedural violations and content in the file on behalf of their members at Disciplinary Board meetings? Do you have any legislation or instructions to restrict this right by board chairmen or civil authorities?
-How does your Ministry monitor the impartiality and legality of these and similar boards, which create the impression that a decision has been made before the defense of the investigated public official has been fully heard and procedural objections have been evaluated?
-Is there any measure or internal administrative sanction mechanism taken by your Ministry in order to prevent the oppressive and abusive approach of administrators representing public authorities towards female managers and employees who are struggling to seek union rights?
"In the last 3 years, how many complaints have been made to your Ministry about union managers who carry out union activities or represent them in disciplinary boards in Gaziantep province and throughout, due to such attitudes, and how many of these applications have been processed?"
