The first hearing was held in the case regarding the death of Gökmen Değirmenci (31), which occurred as a result of the rear-end collision of drug-using car driver Hüseyin Can K. (20) on the Esenyurt Haramidere E-5 highway on February 26.
At the hearing held at the Bakırköy 16th High Criminal Court, the detained defendant Hüseyin Can K., the complainant Melek Değirmenci and the lawyers of the parties were present.
"I USED DRUGS SO I WOULD NOT BE CAUGHT IN THE POLICE SEARCH"
Arrested defendant Hüseyin Can K., who made his defense at the hearing, said, "I left the shopping mall on the day of the incident, my speed was approximately 110 kilometers, the route I was going to take was a short distance. I cannot go too fast on that road, nor do I put myself in danger. I was not under the influence of alcohol or drugs. I used drugs in a very small amount during the daytime. There was a drug the size of a fingernail. I used drugs in my cigarette pack so that I would not be caught in a police search. The effect wore off in a short time. "It took about 20-25 minutes. I had lost my blood sugar. I was driving on a straight road. The car in front of me was moving fast and slow. I got nervous and turned to the right. At that moment, the airbags of the vehicle exploded in my face. I couldn't sleep at night because of my conscience."
HE DEMANDED THE DEFENDANT TO BE PUNISHED
Complainant Kemal Değirmenci, who made a statement through a sign language expert at the hearing, stated that he had a complaint against the defendant and asked for punishment. The complainant's lawyers, who made a statement, requested the defendant's continued detention. The defense lawyers of the defendant requested the release of the defendant.
THE DEFENDANT'S DETENTION WILL CONTINUE
Announcing its interim decision, the court panel ruled that the defendant Hüseyin Can K.'s detention should continue and postponed the hearing to correct the missing issues.
FROM THE INDICTMENT
In the indictment prepared by the Bakırköy Chief Public Prosecutor's Office, Gökmen Demirci was listed as the 'victim' and Hüseyin Can K. was listed as the 'defendant'. The indictment included the traffic detection report. In the report, it was stated that the car hit the motorcycle driven by the victim from behind and then hit the pedestrian railings and other motorcycles on the road.
In the report, it was stated that due to the first impact, the motorcycle driven by the victim skidded and hit the pickup truck approximately 85 meters away, and as a result of the accident, the defendant violated the lane monitoring and changing clause.
WHILE THE DEFENDANT WAS FOUND TO BE 'PRINCIPALLY DEFECTIVE', IT WAS TRANSFERRED THAT THE VICTIM WAS NOT FOUND TO BE FAILURE
The expert report prepared regarding the accident was also included in the indictment. In the report, it was stated that Hüseyin Can K. was maneuvering left and right by constantly changing lanes in the direction of Silivri, and when he came to Haramidere, he switched from the left lane to the right lane without reducing the speed of the vehicle, without giving a sign or warning, endangering the life and property safety of other drivers. In addition, the report included information that the victim was 'primarily at fault' by hitting the motorcycle driven by the victim, who was driving in the right lane in front in the same direction, from behind and violating the lane changing rules in a way that would disrupt or endanger traffic.
In the expert report, it was also emphasized that the victim Gökmen Değirmenci had no fault, and that the other vehicle drivers on the route had no fault in the accident.
A DRUG SUBSTANCE WAS FOUND IN THE DEFENDANT'S BLOOD
The report from the Forensic Medicine Institute was also included in the indictment. The report stated that no alcohol was detected in the defendant's blood, but drugs were detected. The autopsy examination performed on the victim was also included in the indictment. It was stated that there were no drugs, stimulants or pharmaceutical active substances in the victim, and that the death of the person occurred as a result of head, rib, vertebra and extremity fractures due to general body trauma, as well as internal bleeding damage resulting from brain hemorrhage, brain tissue damage, internal organ and large vascular injuries.
REQUEST FOR UP TO 25 YEARS OF PRISON
In the indictment prepared, it was requested that the defendant Hüseyin Can K. be punished with a prison sentence of 20 to 25 years for the crime of 'causing death with possible intent'.
