Fachin defends collegial analysis in the STF on crisis involving ministers

The assessment is that the accusations and questions that have come to light in recent days need to be analyzed by all ministers, and not just through individual decisions. Fachin also expressed discomfort with the way both sides have been conducting the clash.

In a speech this Friday (4), the president of the STF stated that no authority is above the Constitution and that the response to "serious" facts will be "firm".

He also stated that the "seriousness" of the events made public this week - which involve banker Daniel Vorcaro's relations with ministers of the Court and with the Attorney General of the Republic, Paulo Gonet, and the actions of magistrates - "does not authorize shortcuts".

The intention, according to reports, is to wait for responses and statements from Moraes and Mendonça about the episodes that gave rise to the crisis before defining the course of action. Then, submit it to the other members of the court for a discussion and, subsequently, lead to a debate in plenary.

The expectation is that both Moraes and Mendonça will be asked to declare themselves prevented from voting in the trials.

Fachin would not have indicated what his position will be on the merits of the accusations or which outcome he considers most likely. The approach advocated at this time is to listen to those involved, gather the necessary elements and then take the discussion to the STF plenary.
