In the incident that took place at around 08:00 on Wednesday, April 1, on Ertuğrulgazi Street in Nenehatun District, Çetin Kaya, a married father of two, came to the truck to go to work. While he was starting his vehicle, a suspect wearing a helmet came out of hiding under the truck and shot Kaya with a gun. Upon notice, police and medical teams were dispatched to the scene.
Public Security Branch Directorate Homicide Bureau teams launched a large-scale investigation into the incident and determined that the person who carried out the attack was Kaya's 47-year-old brother Sedat Kaya. Sedat Kaya surrendered to the police at around 12:00 on the day of the incident, along with the gun he used in the murder. Kaya, who was referred to the courthouse after his procedures at the police station, was arrested by the court and sent to prison. It was also reported that the defendant stabbed his 42-year-old father, Cemal Kaya, to death in Akse Sapağı, Gebze district, in 1995, when he was only 16 years old.
The murder, which was initially thought to be a matter of inheritance and money, turned out to be another family tragedy dating back years. Allegedly, S. At that time, it was learned that his father did not want him to meet his thieving friends and for this reason he slapped him, and S. Kaya got angry and did not go home at night. It was stated that father Cemal Kaya, who left the house to find S. Kaya, met his son at the turnout, received a rejection response even though he said "Come home", and as he turned around, his son stabbed him in the back with a knife bought from a watermelon seller and killed him. It was recorded that S. Kaya went to prison after this murder.
It was claimed that after the father's murder, other members of the Kaya family cut off all communication with S. Kaya, and the suspect could not tolerate this exclusion and had conflicts with his family members from time to time.
In the video review report entered into the file, it was stated that Sedat Kaya entered the back of the truck around 05:00 and hid there. It was determined that Çetin Kaya approached the truck at around 07.22, got into the vehicle about 2 minutes later, and Sedat Kaya got out of the middle of the truck, opened the door of the vehicle at 07.27 and shot his brother. The footage showed the moment when the defendant came out from under the truck and shot his brother.
In the indictment, when all the evidence in the file is evaluated together, it is stated that the defendant hid between the tow truck and the trailer part of the vehicle and waited for the victim to arrive for approximately 2 hours and 27 minutes, and that after Çetin Kaya got into the vehicle, he fired 3 shots and fled the scene. The indictment also stated that the defendant had threatened to kill his brother many times due to long-term hostility, and that he came to the scene with a gun and wearing a helmet to avoid being recognized.
The indictment also included that the defendant sent a message to his brother Çetin Kaya on March 18, saying, "Happy birthday. Such beautiful days are unforgettable. I will present your gift to you and Cemal."
In the indictment, it was stated that the defendant waited by hiding between the trailer and the tow truck of the truck for approximately 2 hours and 27 minutes, there was a long-standing enmity between him and his brother, he threatened to kill the victim many times before the date of the incident, he went to the scene with a gun and a helmet, and the message he sent was evaluated together and it was concluded that the action was "carried out in a planned and cold-blooded manner".
In the indictment, it was stated that the defendant said that he found the gun he used in the incident on a bus in 2025, when he was an assistant, and that the suspect K.Ş. did not give him a gun. However, it was stated that informed people declared that the gun used in the incident belonged to K.Ş., and as a result of the investigations, it was determined that the gun belonged to K.Ş. For this reason, it was evaluated that K.Ş participated in the defendant's action by providing weapons.
A lawsuit was filed against Sedat Kaya for "premeditated murder against his brother" and "purchasing, carrying or possessing unlicensed firearms and bullets". The first hearing of the case held at Gebze 2nd High Criminal Court was attended by the detained defendant Sedat Kaya, the unarrested defendant K.Ş., against whom a lawsuit was filed for "aiding deliberate murder", Çetin Kaya's relatives and the lawyers of the parties.
Sedat Kaya, whose defense was taken, argued that there was hostility between him and his brother due to the murder of his father, that he went to the scene to talk to end this hostility and that he did not have the intention to kill. The defendant, who claimed that his brother Çetin Kaya touched his gun, said that he shot for this reason. Kaya also stated that the reason he wore a helmet on the day of the incident was to prevent damage to his face.
The court board decided to continue the detention of the defendant Sedat Kaya, and to continue the detention of the defendant K.Ş. It decided to continue the judicial control measures against him and postponed the hearing.
Making a statement after the hearing, Çetin Kaya's older sister, Seda Aytekin, said that they wanted justice. Aytekin stated that, as a family, they have experienced great pain in the past due to the actions of the defendant and said, "We have already been subjected to torture in the past. I want justice from our state elders. We were tortured by the defendant at the time. We were people who grew up without a father. My brother's children experienced the same thing. I did not lose a sibling, I lost my life. I lost my companion. I was orphaned when I was little, and now my children are experiencing the same pain."
Stating that they are waiting for justice to be served after his brother's death, Aytekin said, "I hope that justice will be served after seeing my brother's blood-covered face. Let them be my voice. My father was not given justice either. Maybe we were young, we could not defend ourselves. I am waiting for justice to be served right now."
Çetin Kaya's other sister, Vildan Kaya, also stated that their pain is still fresh. Explaining that his brother got into his truck after leaving home to go to work, Kaya said that he watched the security camera footage. Vildan Kaya said, "He declares that he came to talk to my brother, but he is a person who wants to talk to my brother... The address of my brother's house is known. He has his phone number. Even though we know that he wandered around his house for months and caused fear to his children and wife, my brother gave a statement to the prosecutor's office and the police station. He asked for restraining order, but it did not happen."
Claiming that the incident took place after the last arguments, Kaya said, "His sister and brother-in-law called my brother, swearing, insulting and threatening him, and then, less than a week after the incident, when my brother got into the truck, Sedat Kaya came out from under the truck and shot at my brother while wearing a helmet. It was not enough for him to shoot. He fell to the ground and even though he fell, he unloaded bullets on my brother, who was injured."
Vildan Kaya, who stated that she watched all the security camera recordings about the incident, said, "A person cannot act like this to talk to his brother. Putting on his helmet is a different question. Shooting in the car is a different question. Dropping it on the ground and shooting himself in the head on the ground is a different question."
Stating that he trusts in justice, Kaya said, "My brother was left fatherless at the age of his child. The defendant shot my father in 1995 and shot my brother in 2026. He made my brother's children experience the life my brother lived. I seek refuge in justice, I trust in justice. There was a man in our family, Çetin, Çetin is gone, but Sedat should not stay either. He should receive the necessary punishment."
The complainant's attorney, lawyer Uğur Altun, also argued that the defendant had planned the action. Stating that according to the camera records, the defendant came behind the truck around 05:00 and hid there waiting for the victim to arrive, Altun said, "As shown in the camera records, the defendant comes behind the truck in a planned manner around 05:00 and hides here. He waits for the victim to arrive. From there, he secretly opens the door of the truck that the victim was driving behind his back and shoots himself, causing his death."
Stating that it was decided at the hearing to continue the defendant's detention, Altun said that judicial control measures against the other defendant were also continued. Stating that there are some records in the file that still need to be analyzed, Altun stated that these will be added to the file later. Altun said, "We, as the family and as the complainant's representative, requested that he be punished to the maximum extent. I hope he will be punished to the maximum extent."
Lawyer Altun stated that it was also stated in the court that the defendant had deliberately killed his father and stabbed his mother in the past. Altun said, "The defendant, who had previously committed intentional murder against his father and stabbed wounds against his mother, lastly committed intentional murder against his deceased brother Çetin Kaya."
Arguing that the danger would continue if the defendant was released, Altun said, "We mentioned that if the defendant is released, this will spread to someone else in the family and the danger will continue." Altun stated that it was submitted to the file by the complainants and witnesses that the defendant was around the victim's house before the incident and said, "It has been clearly presented to the file by the complainants and witnesses that the defendant passed by the victim's house before the incident and was wandering around there with his daughter. It is also proven by witness statements."
Altun said that it was also submitted to the file that the defendant used expressions such as "Have a nice day, I have a surprise for you. This will be your last birthday" on Çetin Kaya's birthday on March 18.
