Objection to ATK report on the accident regarding the death of Işıl Öykü Dinç

14-year-old Işıl Öykü Dinç, who wanted to cross the road in Pendik, Istanbul, on May 18, 2025, died as a result of being hit by the vehicle controlled by Ömer Faruk Ballı, who was alleged to be the driver of the car.

The Forensic Medicine Institute report regarding the traffic accident was entered into the file. The report of the Traffic Specialization Department of the Forensic Medicine Institute, which found Dinç to be primarily at fault and the defendant driver Ömer Faruk Ballı to be faultless, was objected to.

Upon the objection of the Dinç family, the Istanbul Anatolian 56th Criminal Court of First Instance sent the file to the Extended Supreme Board of the Traffic Specialization Department of the Forensic Medicine Institute and asked for the fault status to be re-determined.

THE COLOR OF THE LIGHTS IS UNCERTAIN

In the petition of objection prepared by the family's lawyer, it was stated that the report contradicted the evidence in the file and that the evidence against the defendant was ignored while relying on comments in favor of the defendant.

In addition, in the objection text, it was stated that the Forensic Medicine Institute report concluded that the defendant passed the green light, although there was no definitive technical data regarding which direction the traffic lights turned green, and that the statements of the eyewitnesses heard after the incident regarding the speed of the defendant's vehicle were not evaluated in the Forensic Medicine Institute report.

'IT WAS AN UNACTUAL REPORT'

Speaking to Cumhuriyet, Dinç's father, Yunus Dinç, stated that they objected to the ATK expert report, which was filed in May, and argued that the report was prepared contrary to the facts.

Dinç said that after his objections were accepted by the court, the file was referred to the Traffic Specialization Department Extended Board of Experts. Stating that the new expert report has not yet reached the file, Dinç said, "There has been no response from there yet, no new report. We are waiting for it. We will all wait and see what kind of development will happen."

Stating that they welcomed the court's sending the file to the expanded board of experts, Dinç said, "It is pleasing that the court and the judge referred it to this expanded board of experts. Because it was a report that was untrue, a report that was incompatible with reality."

The 4th hearing of the case regarding the death of Işıl Öykü Dinç will be held on Friday, September 11, at 11:00.
