Judge annuls São Paulo City Hall’s selection process for hiring teachers

The decision was made by judge Alexandre Miura Iura, from the Public Finance Court, and was signed this Thursday (3). The process provided for immediate vacancies, in addition to reserve registration for higher-level teaching positions.

According to the ruling, the direct hiring of the firm was irregular because the institute did not prove that it had an “unquestionable ethical and professional reputation”, a requirement provided for in the Tender Law.

Despite the annulment, the teachers' contracts that have already been signed will be maintained until the end of the 2026 school year, to avoid losses to students and the interruption of classes.

From 2027 onwards, the City Hall will not be able to renew these contracts, extend the selection process or make new class assignments based on the annulled selection or the law considered unconstitutional.

The judge also pointed out that City Hall failed to comply with a second instance decision when approving the selection process and calling candidates. Judicial authorization allowed the procedure to progress only until the final results were announced.

The action was proposed by the Public Ministry, which questioned the hiring of the panel, the extension of the contract and the legality of the selection process.

The decision is still subject to the necessary review and will be analyzed in the second instance.

In a note, the City Hall informed that it has already called up teachers through the selection process, that it is holding a public competition for teaching and that it is studying alternatives to serve the municipal network from 2027 onwards.
