Sandro Aparecido da Silva, 49 years old, suspected of feminicide against his wife, in Ponta Porã, is free, even after the Civil Police requested his preventive detention. The court has not yet decided whether or not he should be arrested due to a conflict of jurisdiction between judicial bodies over who should lead the process.
According to the Civil Police, Sandro is suspected of killing his wife, Wandete Gois da Silva, 58 years old, who was run over by a truck on August 2, on BR-463, in the region of the Sanga Puitã interchange, in Ponta Porã.
g1 contacted Sandro's lawyer, but did not receive a response until the last update of this report.
Initially, the case was treated as manslaughter while driving a vehicle. As the investigations progressed, however, the police began to investigate the case as femicide.
Sandro was arrested after the accident, but was released two days later, without the use of an electronic ankle bracelet.
Parallel to the investigation into his wife's death, he also requested the opening of the inventory of the assets left by Wandete.
Understand the case
The Civil Police began linking Sandro to the accident after finding, next to the victim's body, a fragment of plastic that appeared to be part of the fender of a truck.
Two witnesses told investigators that Wandete was at a truck drivers' meeting with her husband. According to reports, the couple left the event together, but it was not possible to confirm whether the two continued in the same vehicle. After that, no one saw the victim again.

Witnesses also reported that Sandro had consumed alcohol and was driving his own truck.
Civil police officers went to the couple's residence and found the truck parked on the street. During the inspection, they found that the fender of one of the wheels on the left side was broken.
Forensics were called again and, after technical analysis, confirmed that the part found on the highway belonged to the truck driven by the suspect.
On the same night as the crime, on August 2, Sandro presented himself at the police station accompanied by two lawyers and was arrested in the act. During the procedure, he refused to take a breathalyzer test.
Two days later, on August 4, he was released to respond to the case outside of prison.
After his release, however, the investigation advanced and the case began to be treated as femicide. On August 13, the Civil Police requested Sandro's preventive arrest, according to information from the Court of Justice of Mato Grosso do Sul (TJMS).
It was then that the conflict of jurisdiction between the 1st Criminal Court of Naviraí and the 1st Criminal Court of Ponta Porã began.
g1 found that the court of the 1st Criminal Court of Ponta Porã declared that it was not competent to analyze the case and ordered that the case be referred to the Court of the 1st Criminal Court and Judge of Guarantees of Naviraí.
The Naviraí court, in turn, also declared itself incompetent to handle the case. As a result, it was up to the TJMS to decide which court should analyze the process.
In a monocratic decision, the reporting judge determined that the Court of Guarantees of Naviraí would provisionally adopt urgent measures related to the case.
The Public Ministry of Mato Grosso do Sul (MPMS) also commented on the impasse. In an opinion issued on September 3, the body understood that it would be up to the Ponta Porã Court to analyze the request.

On the same date, the case was forwarded to the rapporteur of the 3rd Criminal Chamber, responsible for deciding the conflict of jurisdiction. Until the last update of this report, there had still been no decision on which court should definitively handle the case.
Meanwhile, the request for preventive detention remains pending. For this reason, Sandro is not considered a fugitive.
Contacted by g1, the MPMS confirmed the existence of the conflict of jurisdiction and informed that it is up to the TJMS to decide which court will be responsible for the process.
“Due to procedural secrecy, there is no other information that can be disclosed at this time,” added the agency.
TJMS also confirmed to g1 the existence of the conflict.
Inventory request
After being released, Sandro Aparecido requested, on August 17, the opening of the inventory to share the assets left by his wife. The request was presented to the 1st Civil Court of Ponta Porã and has a value of R$ 200 thousand.
Two days later, on August 19, the Court ordered him to present, within 15 days, documents proving his relationship with the victim and, consequently, his legitimacy to request the opening of the inventory.
On September 2, the suspect's defense presented a statement. The judge, however, understood that the legitimacy to request inventory had not yet been sufficiently proven.
On September 18, a new order was published in the Diário da Justiça, considered the last opportunity for Sandro to prove his legitimacy to request the opening of the inventory.
A new deadline of 15 days was granted. If the determination is not met, the request may be rejected.
27th femicide in MS
Wandete's death began to be investigated as a feminicide after images from monitoring cameras recorded, according to the investigation, the moment in which Sandro had run over the woman and then fled.
The case is investigated by the Ponta Porã Women's Assistance Police Station (DAM). The unit only reported that the investigation remains confidential so as not to jeopardize ongoing investigations.
With the new classification of Wandete's death, August became the month with the highest number of femicides recorded in Mato Grosso do Sul since the beginning of the historical series, with 27 victims.
