〔記者王定傳/新北報導〕新北地檢署指揮調查局偵破一起重大違法轉售美國戰略性高科技晶片案,優活科技負責人陳建雄等人,涉嫌從二〇一七年起假冒中科院名義,向國內代理商詐購德州儀器、安德諾半導體產製的高規格管制晶片,再以洗產地、偽裝成非管制晶片手法,走私至中國與香港,獲利三.六億元;檢方斥責陳男等人所為助中國充足武力、影響國安且損及台灣國際形象,依涉犯刑法加重詐欺等罪起訴陳建雄等十人,並對陳求處十年重刑。

檢方調查,被告出口的管制晶片共十多款,原產地為美國、菲律賓等國,可用於雷達、電子偵查、無人機、飛彈、航太電子等軍事用途;依規定要取得這類晶片,須出具最終使用者購買聲明等,以確認最終使用者、用途及流向,若為中國等境外客戶,原廠或代理商即會拒絕交易。

檢調查出,陳建雄曾為知名晶片代理商安馳科技的業務,他利用其開設、掌控的優活等公司或勾結其他業者,偽造最終使用者為中科院,並承諾「不會出口或轉售給受美國制裁對象」,致國內晶片代理商或原廠受騙出售晶片,再以更改型號、外包裝、申報為「台灣製造」等手法轉售給中國或香港買家,獲利一.二億元。
承辦檢察官陳香君查出,另一個詐購晶片者是享得投資負責人賴金蘭,從二〇一九年起勾結華謚科技負責人蔣昆成,以相同手法出售管制晶片給香港買家,其中一款還是美軍軍規認證等級晶片,獲利一.三億元;匯眾通信及展開科技負責人袁同台也模仿上述手法出售晶片,其中一款可用於無人機,獲利一億餘元。
檢方對陳建雄求刑十年,袁同台八年,蔣昆成及賴金蘭各六年,其他六人求處一至三年不等徒刑。
