A lawyer warns of the risks of going to the gym while on medical leave

Lorenzo Pérez, lawyer and CEO of Fidelitis, has warned in a video from the firm on Instagram that extreme caution must be taken if we are on sick leave and carry out activities that contradict it: "What you do in the gym can come to the eyes of the INSS," says Pérez.

The lawyer warns that "your training may end up calling into question your medical leave." Lorenzo Pérez explains that although "being on sick leave does not mean that you have to stay locked up at home", "the problem appears when the activity you carry out seems to contradict the reason for your temporary disability."

That is when "the mutual insurance company or the INSS can begin to question your situation," the lawyer explains in the video.

Lorenzo Pérez explains in the video that "exercising prescribed by a doctor while on sick leave due to anxiety is not the same as lifting heavy weights while on sick leave due to a back injury."

"If exercise is part of your rehabilitation, is recommended by a professional and is consistent with your medical reports, it may be perfectly compatible," says the lawyer.

But in effect, "if you carry out activities that contradict your limitations", Social Security or the mutual insurance company could choose to review the worker's discharge. "The company could even take measures if acting in bad faith were proven," says Pérez.
