NEW Party Group Deputy Chairman Murat Emir reacted to the Ankara Regional Court of Justice's (BAM) waiver of the party's appeal due to the "absolute nullity" decision regarding the CHP congress case.

At the press conference he held in the Parliament, Emir criticized CHP Chairman Kemal Kılıçdaroğlu and his management and the "absolute nullity" decision.

Regarding the CHP's waiver of its appeal due to the "absolute nullity" decision, Emir said, "This is a worthless retraction in our eyes. This is an escape from the judiciary. This is an effort to evade the file from the Supreme Court. Since they know that this decision will most likely result in both the abolition of the measure and the rejection of the file on the merits, in accordance with the law, the law and the decisions of the Supreme Court, this time they are in a hurry to miss the file and escape from the judiciary." made his assessment.

Explaining that according to lawyers, the appeal did not constitute an obstacle to holding a congress, Emir said, "But they did not do it. Because that day, they were doing whatever was necessary to sit in that seat, that is, to plunder all the financial resources and political accumulation of the party. Today, they were in a hurry to bring up a new scenario again because they saw that the end was approaching for them."

"THE PETITION THEY SUBMITTED IS NOT VALID"

Arguing that the waiver of the appeal was legally wrong, Emir said:

"First of all, they do not have the opportunity to withdraw these files, these appeals and objections to the measure. Because this is an abuse of a right. The law never accepts the abuse of a right. On the other hand, their roles as defendants and plaintiffs overlap with that ridiculous injunction decision. Therefore, since a file cannot be both the defendant and the plaintiff of a file, a person, a party, an institution, whatever, the petitions they submit have no validity or legal validity."

Explaining that New Party Chairman Özgür Özel has a legal application as "damaged by the absolute nullity decision", Emir stated that this application will be sufficient for the file to be heard in the Supreme Court.
