यह पूरा मामला नवंबर 2024 में संभल की शाही जामा मस्जिद के सर्वे के दौरान भड़की हिंसा से जुड़ा है.

प्रिवेंटिव डिटेंशन एक ऐसा क़ानूनी प्रावधान है, जिसके तहत किसी व्यक्ति को भविष्य में क़ानून-व्यवस्था बिगाड़ने से रोकने के लिए बिना ट्रायल के हिरासत में रखा जाता है.

अफ़रोज़ ने इलाहाबाद हाई कोर्ट में इस आदेश को चुनौती दी. जून 2026 में हाई कोर्ट ने उनकी याचिका यह कहते हुए ख़ारिज कर दी थी कि प्रशासन को हिरासत में लेने का पर्याप्त आधार लगा था और अदालत सबूतों की गहराई में नहीं जा सकती.

पुलिस का पूरा मामला मुख्य रूप से अफ़रोज़ के उस इकबालिया बयान यानी कन्फेशन पर टिका था, जो कथित तौर पर पुलिस हिरासत में लिया गया था.

अफ़रोज़ का आरोप था कि यह बयान पुलिस ने प्रताड़ना और एनकाउंटर की धमकी देकर लिया था. सुप्रीम कोर्ट ने संविधान के अनुच्छेद 20(3) और भारतीय साक्ष्य अधिनियम की धारा 23 का हवाला दिया.

ये क़ानून किसी भी व्यक्ति को ख़ुद के ख़िलाफ़ गवाही देने के लिए मजबूर करने से बचाते हैं और पुलिस के सामने दिए गए बयान को अदालत में पुख़्ता सबूत नहीं मानते.

अदालत ने अपने फ़ैसले में लिखा, "पुलिस अधिकारी के सामने दिया गया इकबालिया बयान, बिना किसी अन्य स्वतंत्र सबूत के, प्रिवेंटिव डिटेंशन के आदेश को सही ठहराने का आधार नहीं बन सकता."

बेंच ने यह भी पाया कि जिन सीसीटीवी फुटेज और वीडियो के आधार पर अफ़रोज़ को मास्टरमाइंड बताया गया था, वे न तो उन्हें सौंपे गए और न ही अदालत में पेश किए गए.

सुप्रीम कोर्ट ने सख़्त टिप्पणी करते हुए कहा कि राज्य सरकार ने अफ़रोज़ को मिली ज़मानत को बेअसर करने के लिए इस असाधारण क़ानून का इस्तेमाल किया. अदालत ने कहा कि यह हिरासत निवारक यानी प्रिवेंटिव कम और दंडात्मक ज़्यादा लग रही है.

अफ़रोज़ पर लगाया गया प्रिवेंटिव डिटेंशन का आदेश एक साल के लिए था, जो अब कुछ ही दिनों में ख़त्म होने वाला था.

यानी इस आदेश को ग़ैर-क़ानूनी साबित करने की लंबी क़ानूनी लड़ाई में उन्हें अपनी हिरासत की लगभग पूरी अवधि जेल में ही गुज़ारनी पड़ी. इस पर ज़ोर देते हुए सुप्रीम कोर्ट ने अपने फ़ैसले में लिखा, "इस मामले में प्रक्रिया ही सज़ा बन गई."

अदालत ने स्पष्ट किया कि प्रिवेंटिव डिटेंशन एक असाधारण क़दम है और इसका इस्तेमाल बेहद दुर्लभ मामलों में ही होना चाहिए.

अफ़रोज़ की आज़ादी लगभग एक साल के लिए छिन गई थी, हालांकि उन्हें बाक़ी सारे मामलों में ज़मानत मिल चुकी थी, जिनमें वे अभियुक्त थे. इसकी भरपाई के लिए अदालत ने उत्तर प्रदेश सरकार पर 10 लाख रुपये का जुर्माना भी लगाया.

अफ़रोज़ के वकील दिव्येश प्रताप सिंह ने इस फ़ैसले पर प्रतिक्रिया देते हुए बीबीसी से कहा कि वे और उनकी क़ानूनी टीम अदालत के इस क़दम से बेहद ख़ुश और संतुष्ट हैं.
