A woman surnamed Lin in Taichung was fighting against her brother for a property. She attacked and intimidated three female lawyers appointed by the other party. She was sentenced to 1, 2 and 1 year in the first instance for assault and intimidation. When she appealed, she said that she had deeply reflected and had a good attitude after the crime. She requested a suspended sentence. Unexpectedly, when she appeared in court, she lost control and slapped the chairman of the Lawyers Association. She also said, "I slap lawyers all over the world." The Taichung High Court found that she was in contempt of justice and the case of attacking and intimidating female lawyers dismissed the appeal, and the entire case was confirmed.
The whole case arose from a property issue between Ms. Lin and her brother. Ms. Lin was suspected of being dissatisfied with the outcome and process of the lawsuit, so she turned her anger towards the lawyer appointed by her brother. During the first court session, she not only insulted the female lawyer in court but also slapped her in the face. Later, another female lawyer also became the target of Ms. Lin. Ms. Lin even lurked outside the court with unknown liquids, followed the female lawyer into the alley, threw the liquid, and stretched out her hands to pull the opponent's hair and arms, which frightened the female lawyer and fled into the supermarket to seek help.
The case was appealed all the way to the High Court. Not only did Lin not restrain herself, she also humiliated another female lawyer in court with unbearable words and even threatened to kill someone. When Lin's case for assaulting a lawyer was re-opened on March 17 this year, Wu Zhonghe, the chairman of the Taichung Lawyers Association, was waiting in the corridor with several lawyers. Upon seeing this, Lin stepped forward to provoke Wu, suddenly slapped Wu on the left side of his face, and cursed the Three-Character Sutra. Finally, he threatened to kill someone on the Internet, and was finally arrested and taken into custody by the prosecutor in court.
Lin was sentenced in the first instance for five crimes, including intimidation. Among them, she was sentenced to 1, 2 and 1 year for intimidating and injuring a female lawyer. She appealed against the appeal, arguing that she confessed everything after the crime, that she had deeply reflected during her detention, and emphasized that "there is no risk of committing another crime". She was willing to reconcile with the two female lawyers and hoped to have her sentence reduced and given a suspended sentence in accordance with Article 59 of the Criminal Law. However, when another case was heard in court on June 17, she got into a heated argument with the bailiff and even said in court, "I slap all the lawyers in the world."
The Taichung High Court held that Ms. Lin had never known each other and had no personal grudges with the female lawyer who was attacked. She was only dissatisfied with the civil litigation and vented her negative emotions on the lawyer. She obviously lacked the concept of the rule of law. She also did not reconcile with the victim and compensated her. It was difficult to recognize that she had repented and was unlikely to reoffend. Therefore, the appeal was dismissed and the entire case was confirmed.
