Taitung man was sentenced to 59 days in prison for walking naked late at night

A man surnamed Wen went for a walk at the Taitung County Stadium track and field late at night. He was not wearing any outer pants or underwear, and he was openly walking with his naked body exposed. People who were moving at the scene called the police. After the whole case was heard by the Taitung District Court, Wen was found to have committed an obscene act for public viewing and was sentenced to 59 days of detention for public indecency and a fine. Wen Nan appealed against the first-instance verdict, but the appeal was rejected by the Hualien High Court.

When a man surnamed Wen went to the stadium track one night in March last year, he walked around the scene with his lower body naked and his genitals exposed without wearing pants or underwear. At that time, there were still people exercising in the sports ground, and the man even tried to approach a woman who was jogging with headphones on. Another protester from behind noticed his abnormal behavior and shouted "Don't come closer" on the spot. The man then fled the scene in a hurry.

Not long after, after witnessing the woman meeting her husband, she found the clothes left by the man on a chair in the middle of the track and field. The witness couple stopped him on the spot and saw at very close range that the man was only wearing a jacket that reached his waist, with no covering at all on his lower body. He put on his sports pants directly in front of the two people without putting on underwear first, and then ran away with the clothes in his arms. The public immediately called the police.

During the court hearing, the man admitted that he was not wearing underwear, but denied exposing his genitals. He argued that he had urinary leakage due to illness, and he took off his underwear because he was worried about getting wet. He was also wearing a long shirt that covered his underwear at the time. The defender argued that it was pitch dark at the time of the crime and it was impossible to tell whether he was wearing pants.

However, the judge's investigation found that there was enough light before the stadium lights were turned off at 10 p.m., and witnesses could clearly identify his lower body nakedness. In addition, the hospital diagnosis certificate provided by the man only recorded surgical records such as appendicitis, and did not have any diagnosis related to urine leakage. Moreover, the man's statements about carrying underwear were inconsistent, and witnesses also witnessed him putting on trousers instead of changing underwear.
